Mr. Allison,
The Division of Waste Management, Solid Waste Section (Section) received your submittal
titled MSW Transfer Station Permit Application Package (document ID number 24006). The
document was submitted on your behalf by Brooks Engineering Associates and was received in
the Asheville Regional Office on March 12, 2015.
In accordance with North Carolina General Statute 130A-295.8(e), the Section reviewed the
application to determine if all required components were included. Following this review, a
Determination of Completeness – Application Incomplete letter (document ID number 24049)
was issued on March 26, 2015. The application was deemed incomplete because the zoning
letter required by North Carolina Administrative Code Title 15A, Subchapter 13B .0401(2) was
not included.
Subsequent to the Determination of Completeness letter, you sent an email on August 24, 2015
with a partial scan of the Buncombe County Board of Adjustment Order indicating the denial of
a conditional use permit for zoning purposes. No further written communication regarding this
permitting activity has been received by the Section since receipt of this email.
If you are no longer interested in pursuing this permitting activity, it is requested you provide
written notification to that effect. Otherwise, in order to continue this permitting activity, you
must respond to the deficiencies in the application within 30 days of the date of this letter.
Failure to do so will result in denial of the permit action and cancellation of the requested
permitting activity.
