Dear Ms. Everett:

The Division of Waste Management (DWM), Solid Waste Section (SWS) has completed review
of the permit application for constructing and operating Everett’s Land Clearing and Inert Debris
Pit (DIN 27057), which is on your behalf prepared by J. Branch Smith, P.E.

Based on the reviews, the SWS has no further comment on the above-referenced permit
application at this time and hereby issues you (property owner) and Everett’s Lot Clearing and
Grading, Inc. (operator of the above-referenced landfill) the Permit Approval to Construct &
Operate (PTC/PTO) in accordance with Section .0201(e) and consistent with Sections .0203 and
.0563(4) of the Solid Waste Management Rules 15A NCAC 13B. Please note that the issuance
of this permit neither exempts you and Everett’s Lot Clearing and Grading, Inc. nor removes
your responsibility to comply with any applicable ordinance, regulation or law that may affect
your facility.

Enclosed please find a hard copy of PTC/PTO (DIN 27055) for Everett’s Land Clearing and
Inert Debris Pit, and the approved permit application and drawings (DIN 27057) is also enclosed.
Please carefully review the permit and pay special attention to the following permit conditions,
which shall be completed prior to receiving any permitted wastes at this landfill facility; the
permit conditions briefly stated below:

 General Permit Condition No. 3, Part IV, Attachment 1 of the permit regarding permit
recordation requirement. The certified copy of the permit (enclosed) must be filed in the
Register of Deeds office in Lenoir County, and the copy (entire document including
permit) is returned to the SWS, within thirty (30) working days, from the date received,
with the page and book number, date of recordation, and Register’s seal.

 Pre-Operational Condition No. 9, Part I, Attachment 2 of the permit.
