I propose concrete pipe sealed watertight. The other option is digging a ditch but any leachate will get in this ditch as well. This pipe is not directly under the landfill as it is in clean fill. (Operations Plan, Waste Disposal Plan, on Page 2 of 6) Pursuant to the Solid Waste Management Rules (Rule) 15A NCAC 13B .0566(5) & (7), the soil cap, at minimum of one foot thickness, shall be installed over the disposal area at the landfill no later than 120 calendar days [not one year, proposed in Item (t)] after completion of any phase of disposal operations. The soil cap must be revegetated at the specified time frame as well. The Item (t) must be revised accordingly. Response: O&M text changed. 2. (Drawing Nos. LCID-2 & LCID-3) A 24-inch-diameter aluminum pipe is added to the revised plan drawings to drain the surface runoff in the ditch along the east side of the landfill into the stormwater holding area, which is located on the west side of the landfill. And this transverse aluminum pipe is to be installed underneath the landfill. The SWS has strong concerns of this design because the buried pipe, if it is damaged or leaks for any reason, will potentially provide a least-resistant path for leachate migration to the on-site surface-water body (stormwater holding area) and consequently to the groundwater underneath the landfill. (Don’t forget what causes the coal ash spill into the Dan River.) Leachate is defined as any liquid, including any suspended components in liquid, that has percolated through or drained from solid waste according to Rule 15A NCAC 13B .0101(24). Please noted that the landfill will be perpetually located at the property, but the pipe has a limited service 2 life. Mr. Everett who owns and operates this landfill will be legally and financially responsible for any environment damages to surface water and groundwater resulting from leachate migration via the damaged pipe. Consequently, this design has a potential violation of the Rule 15A NCAC 13B. .0566(14) - leachate shall be properly managed on site through the use of current best management practices. Additionally, the Permit Application must properly address the following concerns, if Mr. Everett insists to use this approach to manage the on-site stormwater/drainage system: i. According to the “LCID Full-Build Out Cross-Section” on Drawing No. LCID-3, the pipe intake (daylight) is placed on the grade without any backfill cover, and approximately 50% of the pipe is covered by less than 1-foot thick cover. a. Will this pipe be able to resist waste loads (static) and live loads, generated from the movements of dump truck and earth-moving equipment with an acceptable factor of safety? Please provide the detailed calculation to demonstrate the selected pipe has adequate strength to support the maximum static and live loads in construction and operation of the landfill. Site Description This Land Clearing and Inert Debris Facility has been operational for about a year and a half. The previous surface mining permit was attempted to be renewed in 2009 although it may have been closed instead of renewed due to the change of use to a LCID. However, an LCID was not permitted, although documents prepared for a submittal (I don’t have records of a submittal). After inspections by Land Quality staff, it was determined the LCID application should be submitted in order to comply with Solid Waste Rules. Therefore, this is the submitted information in order to comply with 15A NCAC 13B.0565 for LCID landfills. The proposed pit is about 13 acres located off Aldridge Store Rd (SR 1515) in the Institute Township of Lenoir County as referenced by Deed Book 987, Page 1 and Map Book 19, Page 15 (Parcel Record 4596). The site is georeferenced at Latitude: 35°20'6.35"N and Longitude: 77°43'40.29"W. This LCID has been accepting and will continue to operate with the approved disposal materials of land clearing waste (stumps, green limbs, leaves, grass, soil, yard waste, etc.). The estimated cubic yards of waste at this facility will be 1,000 cubic yards per quarter. The site’s topography slopes from top of pit elevations from 102 to 95 ft MSL (NAVD 88). The pit bottom elevations range from 75 to 81 ft MSL (NAVD 88). Side slopes range from 4:1 to 2:1 in places. The top of the pit is largely vegetated with the exception of the haul road. The bottom and side slopes of the pit are stabilized with vegetation and trees as well. The site lies in the Falling Creek (C;Sw, NSW) watershed of the Neuse River Basin. However, from the top of pit, the drainage runs into the pit and not offsite. II. LCID Point of Contacts There will be no one stationed at the facility on a day-to-day basis. Lynn Everett coordinates and opens the facility if it is to be used. It’s used 2-3x a week at most on a typical work week. There may be certain projects which require a higher frequency use throughout the year as typical in construction. See below for point of contacts and resources for this facility. SHWT Report Evaluation In 2011, Terracon and Fred Smith performed geotechnical borings and seasonal high water table determinations based on soil profiles. The tests, conducted outside of the excavation areas due to ponding of water, indicate these soil profiles were the pre-excavation soil indicators for high groundwater levels. Given the ponding of water within the excavation pits represent the current levels of groundwater and fluctuations of the groundwater are much more dependent on rainfall than hydrogeology. Therefore, using the Terracon report and borings would mean the bottom of the pit would have to be filled-in by 10-ft in most areas, but if the current water levels are used, the bottom of the pit would have to be filled- in by 4-5-ft in most areas. Current water levels would indicate the base conditions and seasonal high levels would be irrelevant based on the rainfall as described herein. (b) The approved disposal materials shall be land clearing waste (stumps, green limbs, leaves, grass, soil, yard waste, etc.). (c) Per 15A NCAC 13B .0101(22), means a facility for the land disposal of land clearing waste, concrete, brick, concrete block, uncontaminated soil, gravel and rock, untreated and unpainted wood, and yard trash. (d) The disposal of any material other than those listed above shall be prohibited (15A NCAC 13B.0563). (e) The estimated cubic yards of waste at this facility will be 4,000 cy/year. See LCID maps and permit. (f) Waste from any county in NC will be permitted but most likely only Lenoir, Wayne, Craven, Pitt, Greene, Duplin, Onslow, and Jones counties. (g) The equipment will be dump trucks and dozers mainly and excavators may be used to place fill dirt on occasion. (h) The facility is gated and locked daily. (i) The hours of operation are M-Sat. dusk till dawn but the facility is not active but a few times a week. (j) This facility is not open to the public but private use only. (k) Signs are located at the facility to describe the types of acceptable wastes, prohibited wastes, operating hours, permit number, and emergency contact numbers. (l) Haul roads will be maintained for all-weather access. (m) No temporary storage of unacceptable waste shall be stored onsite. Unacceptable wastes such as waste tires, appliances, construction and demolition waste, and household garage must not be disposed in the LCID Pit and hauled to the regulated landfill as listed below. Water may be used onsite to fight fires, but the local emergency responders will be contacted to fight any fires. All equipment must contain working fire extinguishers. (t) The fill material will be excavated from onsite. A 1-ft soil cap will be installed on the LCID waste within 120 calendar days of no activity on site. (w) Closure of the facility will be in accordance, at a minimum, to Rule 15A NCAC 13B .0566(5) and notification made to the Solid Waste Section of NCDEQ. Stormwater Best Management Practices (BMP) for this facility are essentially the erosion control measures and details. (b) Receiving Waters on NC State 303(d) impaired waters list or located in a watershed established TMDL: N/A - Falling Creek 303d Impaired Waters 303d Impaired Waters (c) The potential pollutants and total suspended solids that could be expected from these solid waste operations are dust and sediment-runoff, non-road and road grade diesel fuel, motor oil and lubricants, equipment lubricants and chemicals. Sediment-runoff results from exposed slopes, haul roads, stockpiles, wastepiles, and other land disturbing activities. Dust is typically generated from truck and excavator traffic along haul roads. Fertilizers and other chemicals would be used for land reclamation or seeding and could be washed from slopes and other disturbed areas. Equipment fuel and lubricants could spill or wash onto the ground during hauling, excavation, and dumping operations, and during maintenance or repair. There are multiple other chemicals and pollutants listed in the Materials Safety Data Sheet (MSDS) notebook in the construction field and main offices. A MSDS sheet is found for all chemicals on site. Also, the same list is found in the Hazard Communication Program notebook in the office. (b) An oil Spill Prevention Control and Countermeasure Plan (SPCC) is not required by Federal regulations, specifically the Mining Health and Safety Administration (MHSA), although the spill prevention control and countermeasures are detailed for all chemicals and pollutants in the MSDS notebook in the office. (c) Everett’s Lot Clearing and Grading, Inc. personnel responsible for implementing the SPRP are all employees and personnel trained to work in the LCID Pit operations on site. (d) Permanent Fuel storage is not planned for this facility and any temporary storage vessels shall be removed from the site daily. (e) Any and all containment structures for Bulk Storage of Liquid Materials per Section 313 of Title III of the Superfund Amendments & Reauthorization Act (SARA) are not located in a Special Flood Hazard Area Zone AE or any areas subject to flooding. Oil absorbent material shall be available if it is necessary to use. The unusable fuel/oil and the contaminated soil in the area will be excavated and disposed of in accordance with State and/or Federal regulations. (g) All unloading of transport vehicles to fill fuel tanks will meet minimum requirements and regulations established by the U.S. Department of Transportation (US DOT) and MHSA. The tanks will be attended while filling to prevent overflow, and to note visible leaks from seams, gaskets, valves, etc. If spills are evident, the contaminated soil will be excavated and disposed to an approved landfill or contact the Division of Waste Management. If the spills continue, a paved unloading ramp equipped with an oil-water separator may need to be constructed. (h) If any other spills that involve equipment lubricants and chemicals occur, the spill shall be cleaned up, excavated and disposed to an approved landfill or contact the Division of Waste Management. (i) All personnel who are in any way connected with the pollutants listed above, or responsible for storm water drainage and spill cleanup will be made familiar with this plan, and a copy of this plan will be posted and readily available to all personnel at the main office and field offices. 6 PREVENTATIVE MAINTENANCE AND HOUSEKEEPING (a) Preventive Maintenance and Housekeeping related to health and safety of personnel and any environmental impacts is discussed and trained to all personnel working in the operations of Everett’s LCID Pit. Mine personnel are expected to be responsible with the pollutants that they are involved with the most. An “Annual Refresher” is a training course by Everett’s Lot Clearing and Grading every year that includes preventative maintenance, housekeeping, and MSDS. In addition, job-specific training is required for all new employees, which also includes preventative maintenance, housekeeping, and MSDS.
