STATUS OF PAST NOTED VIOLATIONS: 1. RESOLVED: 15A NCAC 13B .0534(b)(2)(A) states, in part, “…Duty to Comply. The permittee must comply with all conditions of the permit, unless otherwise authorized by the Division.” Burke County was in violation of 15A NCAC 13B .0534(b)(2)(A) in that they failed to maintain the processed and unprocessed wastes in reasonably sized piles with adequate fire breaks and lanes. During this inspection there was one pile of yard trash on site in a reasonably sized pile with adequate fire breaks and lanes. Therefore, this violation is considered resolved. 2. RESOLVED: 15A NCAC 13B .0542(f)(1) states, in part, “…the owners and operators of all C&DLF units must cover the solid waste with six inches of earthen material when the waste disposal area exceeds one-half acre and at least once weekly.” Burke County was in violation of 15A NCAC 13B .0542(f)(1) in that they failed to cover the C&D waste with at least six inches of earthen material when the waste disposal exceeded one-half acre and at least once weekly. During this inspection the area in question was no longer in use and had been closed. The working face at the current cell (Phase 1A) was small and well controlled. Mr. Ingram, Landfill Operations Supervisor, noted that the working face is covered at least weekly with six inches of earthen material. Therefore, this violation is considered resolved. 3. RESOLVED: 15A NCAC 13B .1604(b)(2)(A) states, in part, “…the permittee shall comply with all conditions of the permit.” 15A NCAC 13B .1627(d)(1)(A) states, in part, “…Following closure of each MSWLF unit, the owner or operator shall conduct post-closure care. Post-closure care shall be conducted for 30 years, except as provided under Subparagraph (2) of this Paragraph, and consist of at least the following: (A) Maintaining the integrity and effectiveness of any cap system, including making repairs to the cover as necessary to correct the effects of settlement, subsidence, erosion, or other events, and preventing run-on and run-off from eroding or otherwise damaging the cap system. Burke County was in violation of 15A NCAC 13B .1604(b)(2)(A) and 15A NCAC 13B .1627(d)(1)(A) in that they failed to establish and maintain a vegetative cover on the lower southwestern slopes of the closed MSW landfill. During this inspection the area in question had previously been hydro seeded and ground cover was established on the lower southwestern slopes of the closed MSW landfill. Therefore, this violation is considered resolved. 4. RESOLVED: 15A NCAC 13B .1625(a) states, in part, “The operator of a MSWLF unit shall maintain and operate the facility according to the operation plan prepared in accordance with this Rule.” Burke County was in violation of 15A NCAC 13B .1625(a) in that they accepted and comingled plywood & other manufactured (industrial) wood wastes with the wooden pallet waste stream. During this inspection there was no comingling of the waste stream observed. Therefore, this violation is considered resolved. OBSERVED VIOLATIONS: None. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 4 ADDITIONAL COMMENTS 1. Partial site inspection to assess compliance with NOV from previous site inspection in 2014. 2. Burke County provided documentation (letter dated February 6, 2015) which stated that they have established North Carolina Fire Code (NCFC) recommended guidelines in regards to pile sizes on site and are currently adhering to NCFC Section 1908.3 and 1908.4. During this inspection there was only one pile of yard trash on site which conformed to the NCFC as stated above. Please continue to ensure that all piles are reasonably sized with adequate fire breaks and lanes. 3. Mr. Hollifield noted during this inspection that Burke County is considering establishing an LCID landfill on site to help manage future pile size. Please contact Allen Gaither, in SW Permitting, at 828-296-4703 for any necessary permits. 4. During this partial inspection windblown litter appeared to be well controlled. 5. Maintenance of sediment basins had recently occurred. 6. Hydro seeding of the recently closed C&D landfill cap on top of the closed MSW landfill has occurred. Maintain this area as necessary to ensure vegetative cover remains established. Continue to maintain the integrity and effectiveness of the cap system by ensuring vegetative cover is maintained on all slopes. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
