ADDITIONAL COMMENTS
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
OBSERVED VIOLATIONS:
On April 20,2016,John Patrone met with Clarence Summers,Sr.to conduct a comprehensive inspection of the C.L.Summers and Son
Landfill –LCID Landfill on Wagoner Road in Gibsonville,Guilford County.
1.The C.L.Summers and Son Landfill is a notified land clearing and inert debris (LCID)landfill.
2.The landfill is known as Summers LCID Landfill,Inc.
3.The LCID landfill is estimated to be <2 acres.
4.The LCID landfill is primarily used by Clarence L.Summers and Son Trucking and Grading,Inc.but is open to the general public.
5.The LCID landfill is operated by Clarence L.Summers’son –Clearance Summers,Jr.
6.Logs are removed from land clearing debris (LCD)and stored separately to be cut for firewood.
7.Concrete items are stored for reuse along the access road.
8.Demolition debris that had been dumped at the landfill has been removed.A receipt was verified for its disposal at a permitted facility.
A total of 2.11 tons was brought to Coble's Sandrock,Inc.Construction and Demolition Debris Landfill on April 1,2016.
9.Per 15A NCAC 13B .0566(3),“Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into
cells.”It is recommended that LCD deposited around the left front of the landfill be covered with soil and that the facility operate a
compact and small working face.A compact and small working face is more easily covered with soil than a loosely compacted and
spread out working face.
10.Per 15A NCAC 13B .0566(4),“Adequate soil cover shall be applied monthly,or when the active area reaches one acre in size,
whichever occurs first.”Some of the older LCD in the area prior to current operations was covered with soil although not all of it.
However,LCD was being offloaded onto the area during the inspection and the older LCD was covered by new material.
11.Side slopes should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed.
12.The landfill is in the process of being surveyed.
13.Mr.Summers,Sr.stated that the older portion of the landfill contains only soil and the side slopes,of the soil area,contain inert
materials for stabilization.
14.The facility is also a temporary disaster debris staging site (TDDSS).The TDDSS number is:DS41-005.
15.The facility is secured by a locked gate.A log has been placed at the area adjacent to the gate to prohibit vehicles from driving around
it.
16.Open burning of solid waste is prohibited.
17.The facility has an all-weather access road.
18.The facility has a proper sign.It is suggested that the facility identification number is also posted:N0550.
19.Mr.Patrone discussed the abovementioned with Clarence Summers,Jr.via telephone.
20.The SWS will conduct a follow-up inspection by ~May 20th to ensure LCD observed during the inspection is adequately covered with
soil.
