STATUS OF PERMIT:
The Permit to Operate a Small Type 3 Solid Waste Compost Facility was issued on September 4, 2015 and shall expire
on September 4, 2020.
PURPOSE OF SITE VISIT:
Partial Inspection
STATUS OF PAST NOTED VIOLATIONS:
1. RESOLVED: 15A North Carolina Administrative Code 13B .0203(d) states: “By receiving solid waste at a
permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply
with the conditions of the permit.”
During the inspection 8-16-16 leachate was observed ponded on the ground next to the concrete pad. Gallins
Family Farm Compost Facility was in violation of 15A NCAC 13B .0203(d) by not containing and managing
leachate in accordance with the approved Permit to Operate and application. On 10-17-16 the area around the
concrete pad had been graded to allow storm water to discharge into vegetation buffer of grass. Therefore, this
violation is considered resolved.
2. RESOLVED: 15A North Carolina Administrative Code 13B .1406(4) states, “Leachate shall be contained on
site treated to meet the standards of the off-site disposal method.”

During the inspection 8-16-16 leachate was observed ponded on the ground next to the concrete pad. Gallins
Family Farm Compost Facility was in violation of 15A NCAC 13B .1406(4) in that leachate was not being
treated on site to meet the off-site disposal method. On 10-17-16 the area around the concrete pad had been
graded to allow storm water to discharge into vegetation buffer of grass. Therefore, this violation is considered
resolved.

3. RESOLVED: 15A North Carolina Administrative Code 13B .1406(8)(A) Operational Requirements for Solid
Waste Compost Facilities states, “Signs providing information on waste that can be received, dumping procedures,
the hours during which the site is open for public use, the permit number and other pertinent information shall be
posted at the site entrance”.
During the inspection 8-16-16 it was observed proper signage was not posted on the property identifying permit
number, prohibited materials and emergency contact information. Gallins Family Farm Compost Facility was in
violation of 15A NCAC 13B .1406(8)(A) by not posting the required signage. At the time of the inspection the
proper signage had been installed. Therefore, this violation is considered resolved.
4. RESOLVED: 15A North Carolina Administrative Code 13B .1406(8)(C) Operational Requirements for Solid
Waste Compost Facilities states, “Signs shall be posted stating that no hazardous waste, asbestos containing waste,
or medical waste can be received at the site”.
During the inspection 8-16-16 it was observed proper signage is not posted on the property identifying permit
number, prohibited materials and emergency contact information. Gallins Family Farm Compost Facility was
in violation of 15A NCAC 13B .1406(8)(C) by not posting the required signage. At the time of the inspection
the proper signage had been installed. Therefore, this violation is considered resolved.
5. RESOLVED: 15A North Carolina Administrative Code 13B .0203(d) states, “By receiving solid waste at a
permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall
comply with the conditions of the permit.”
At the time of the inspection 8-16-16 Gallins Family Farm Compost Facility was in violation of 15A NCAC
13B .0203(d) in that fences were not installed for site security as required by the approved application. Gallins
Family Farm submitted amendment request to amend the site security statement to Tony Gallagher on
September 30, 2016. Mr. Gallagher approved the request so that the amended site security statement states:
BEFORE - Ponding leachate at the NW corner of
concrete pad. AFTER – NW corner of concrete pad.

“Site Security: A farm gate will be implemented to prohibit unauthorized access to compost site”. As of
the 10-17-16 inspection a farm gate was installed as required. Therefore, this violation is considered resolved.
6. RESOLVED: 15A North Carolina Administrative Code 13B .0203(d) states, “By receiving solid waste at a
permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall
comply with the conditions of the permit.”
During the inspection 8-16-16 an abundance of vectors were observed consisting of various insects and birds
attracted to the active windrows. By not managing vectors in accordance with the approved application Gallins
Family Farm Compost Facility was in violation with 15A North Carolina Administrative Code 13B .0203(d).
To address the vector concerns Gallins Family Farm Compost Facility had stockpiled approximately 1,000 yards of
carbon material onsite and at the time of the 10-17-16 inspection had applied approximately 6 inches of the carbon
material to the active windrows as required. Therefore, this violation is considered resolved.
ADDITIONAL COMMENTS
1. This was a follow up inspection for the 8-16-16 comprehensive inspection to inspect the observed violations.
2. No odors were detected around the western side of the pole shed and in and around the finished rows of compost in
the field.
3. Thank you for correcting the observed violations in a timely manner.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
