PURPOSE OF SITE VISIT: Closure Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The facility ceased operating as an LCID landfill, and on 03/23/2016 an email was submitted to Ming Tai-Chao, Permitting Branch, requesting that the permit renewal application be withdrawn and returned. 2. The property was sold to Ranch Properties LLC on September 4, 2015. The facility closure process will be implemented through the current property owner. 3. Access to the site is restricted by means of a gate which is kept locked when the property owner is not at home. 4. Access roads are of all-weather construction and well maintained. 5. The facility had included a mining operation under permit # 79-25. 6. No edge-of-waste markers were observed at the site. Mr. Osborne stated that the site had been surveyed, and pins had been set marking the corners of the area identified as, “MINING PERMIT BOUNDARY” on the site grading plan, sealed by William E. Mitchell, PE on April 23, 1993. Each of these four pins was pointed out by Mr. Osborne and observed during the inspection. 7. By November 30, 2016, ensure that permanent edge-of-waste markers are installed around the perimeter of the LCID landfill to indicate the actual location of the outer boundary of the waste that was disposed of in the landfill. 8. A letter, dated September 22, 2016, was received from William E. Mitchell, PE, certifying that more than 12 inches of suitable soil cover had been placed over the entire landfill. 9. No ponding of water was observed on top of the fill area or along the toe of the landfill and no signs of erosion were observed. 10. Side slopes were properly graded and observed to have well-established vegetative cover. 11. On the landfill top, vegetative cover was observed only in areas where equipment, materials and supplies were not being stored and where trucks were not operating. 12. Woody growth and small trees were observed on the side slopes along the northeastern perimeter of the landfill, as was the case during the March 9, 2016 inspection. 13. By November 30, 2016, ensure that all woody growth and small trees on the side slopes and around the perimeter of the fill area are removed and the areas surrounding them are stabilized.
