To correct the violation, the Town of Laurel Park must maintain compost stockpiles at or above 55 degrees Celsius (131o F) for three days and record the temperature data prior to distributing material to the public. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on October 18, 2016. 2. The facility is not open to the public and is used by the Town of Laurel Park 3. The access roads are constructed of gravel and were in good condition at the time of inspection. 4. It appeared that less than 6000 yds3 of material on site at the time of inspection. 5. Grinding at the facility occurs on a yearly basis. 6. The facility is currently accepting land clearing debris and yard trash. Leaves and grass clippings were observed in the material stockpile. Please note that leaves and grass clippings are considered yard trash and must be composted and temperature data must be kept. 7. Mr. Griffin stated that the facility has not been taking temperatures of the stockpiles. Per 15A NCAC 13B .1406(10): “Compost process at Type 1 facilities shall be maintained at or above 55 degrees Celsius (131 degrees F) 3 days and aerated to maintain elevated temperatures.” Please see observed violations section of this report. 8. It is recommended that limbs and stumps be kept in separate stockpiles from leaves, grass clippings and other yard trimmings that are required to be composted. 9. Please ensure that a clear unobstructed path is maintained around all stockpiles of ground and unground material to allow access by firefighting equipment. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
