OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0836 (a) states: No person, shall establish on his land, or allow to be established on his land, a septage detention facility, unless a permit for the facility has been obtained from the Division or the facility is operating in accordance with a NPDES permit issued by the NC Division of Water Quality.
You were in violation of 15A NCAC 13B .0836(a) in that on September 23, 2016, a septage detention facility was
established on your property without a permit issued by the Division.
On September 23, 2016, four 250 gallon plastic Intermediate Bulk Containers (IBC) totes were observed at 482
John Teague Road, Franklin, NC. One tote was full and the other were empty but three contained residual
septage material.

ADDITIONAL COMMENTS
1. Photographs were taken on September 23, 2016 by Troy Harrison.
2. On September 8, 2015, Deb Aja, Western Regional Supervisor, North Carolina Solid Waste Section, Field
Operation Branch received a complaint concerning the storage of septage in “500 gallon rain barrels” by Mr. Greg Raby on his property at 482 John Teague Road in Franklin, NC.
3. On September 23, 2016, Mr. Harrison (the writer) Solid Waste Section, went to the site to conduct an investigation. Mr. Harrison called Mr. Raby at approximately 11:15 AM and left a message informing him that
the Solid Waste Section had received a complaint. Mr. Raby returned Mr. Harrisons’ call and agreed to meet at the site. At the site four 250 gallon plastic totes were observed. One tote was full and the other three were empty but contained residual septage material. Mr. Raby stated that he has used all four tanks. No septage was
observed on the ground outside of the tank or around the property. What appeared to be yellow grease was also observed on the property in tanks and on the ground but that is not considered septage.

4. A new pumper vehicle was on the property that appeared to not have been used and had been recently lettered. The new vehicle is to be used for portable toilet waste.

5. The tank appeared to be structurally sound and bolted to the frame.
6. Valves and access ports appeared to be secure. Caps were present on the access ports.
7. The truck was properly marked in accordance with the lettering requirements.
8. No leaks were observed.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

9. Mountain Septic Service has paid the annual fee of $800.00 for multiple pumper vehicles. *When the vehicle
is placed in service you will need to submit the NC license tag number to michelle.sclafani@ncdenr.gov or troy.harrison@ncdenr.gov
