G.S. 130A-309.10(f)(3): Resolved Transylvania County implemented a mixed load spreadsheet to ensure that loads with mixed waste are directed to the correct areas of the facility and the waste is disposed of in the proper location. Therefore, the violations of 15A NCAC 13B .1626(1)(a) and G.S. 130A-309.10(f)(3) are resolved. 3. 15A NCAC 13B .1626(7)(b): Not resolved, Corrective Measures in Progress. Side slopes around Phase 4 have been seeded and vegetation is becoming established. 4. 15A NCAC 13B .0203(d): Not resolved. Corrective Measures in Progress. OBSERVED VIOLATIONS: 1. 15A NCAC 13B .1626(2)(a) states “Except as provided in Sub-Item (b) of this Item, the owners or operators of all MSWLF units must cover disposed solid waste with six inches of earthen material at the end of each operating day, or at more frequent intervals if necessary, to control disease vectors, fires, odors, blowing litter, and FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 5 scavenging.” Transylvania County is in violation of 15A NCAC 13B .1626(2)(a) by failing to cover all waste at the end of each working day. On the morning of July 20, 2016 the working face of the Phase 5 was observed partially covered with a tarp. Waste on the east side of the working face of Phase 5 was observed uncovered. Waste was also observed uncovered on the west side slope of Phase 4. 2. 15A NCAC 13B .0203(d) states in part: “…by receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” The approved operations plan “Woodruff Landfill, Phase 5 Transylvania County, North Carolina Operations Plan revised March 2010” (DIN 10329) states in section 5.4. (Daily Cover) “At the end of each day's operation, compacted waste in the subcell will be covered with either a minimum six inches of soil, or a tarp (previously approved as an alternative daily cover). When a tarp is used, the minimum of six inches soil cover will be placed once a week. The cover soil placed weekly shall be compacted with minimum of two passes with the compactor. Waste may be covered more frequently than once per day if necessary to control fires, odors, or blowing litter.” Transylvania County is in violation of 15A NCAC 13B .0203(d) by failing to cover all waste at the end of each working day. On the morning of July 20, 2016 the working face of the Phase 5 was observed partially covered with a tarp. Waste on the east side of the working face of Phase 5 was observed uncovered. Waste was also observed uncovered on the west side slope of Phase 4. Uncovered Waste from Previous Days Operation in Phase 5 FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 5 Uncovered Waste in Phase 4 3. 15A NCAC 13B.1626(11)(c) Methods such as fencing and diking shall be provided within the area to confine solid waste subject to be blown by the wind. At the conclusion of each day of operation, all windblown material resulting from the operation shall be collected and returned to the area by the owner or operator. Transylvania County is in violation of 15A NCAC 13B .1626(11)(c) by failing to collect all windblown material and return it to the area at the conclusion of each day of operation. Windblown litter was observed the in the Phase 5 cell and on the slopes of Phase 4 on the morning of July 20, 2016. 4. 15A NCAC 13B .0203(d) states in part: “…by receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” The approved operations plan “Woodruff Landfill, Phase 5 Transylvania County, North Carolina Operations Plan revised March 2010” (DIN 10329) states in part in section 3.6 “Litter Control” “Temporary fences and/or dikes may be constructed to contain windblown material during operations. In addition, landfill personnel will pick up windblown litter as necessary along the access road and around the active disposal area.” Transylvania County is in violation of 15A NCAC 13B .0203(d) by failing to collect all windblown material and return it to the area at the conclusion of each day of operation. Windblown litter was observed the in the Phase 5 cell and on the slopes of Phase 4 on the morning of July 20, 2016. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 4 of 5 Uncollected Windblown Litter in Phase 5 ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on July 20, 2016. 2. The facility moved into Phase 5 of the landfill on July 5, 2016. 3. Visibility was limited due to morning fog at the time of inspection. 4. Upon arrival to the working face at approximately 7:45 am a tarp was observed partially covering the previous days working face. An area approximately 15’ x 25’ of waste on the east side of the working face was observed without cover. Dwayne Smith stated that the reason that waste was left uncovered was because of a lighting storm that occurred at the end of the previous day. All waste must be covered at the end of each day. Please see observed violations section of this report. 5. No measures were in place to keep the tarp secured and prevent scavenging of waste. The tarp must be secured at the end of the day to prevent the possibility of waste becoming exposed. 6. Litter fencing had been placed on the south side of the working face. 7. Windblown material and/or material that had been scavenged was observed to the east of the working face. Please note that windblown material must be collected and returned to the working face at the end of each day. Please see observed violation section of this report. 8. Exposed waste was observed on the west slopes of Phase 4. All waste must be covered at the end of the day. Please see observed violations section of this report. 9. New vegetation from the recently hydroseeded slopes was beginning to become established at the time of inspection. Areas of rill erosion were beginning to start where vegetation had not been sufficiently established. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 5 of 5 Please repair the rill erosion and reseed the areas when favorable conditions for the establishment of groundcover are present. 10. Severe washing on the south slope of Phase 4 was observed which had resulted in waste becoming exposed. Repair the eroded areas on recover the exposed waste. Please see observed violations section of this report. 11. Pallet disposal was discussed with Mr. Brookshire and Mr. Smith. Per NCGS § 130A-309.10(f) “No person shall knowingly dispose of the following solid wastes in landfills (12) Wooden pallets, except that wooden pallets may be disposed of in a landfill that is permitted to only accept construction and demolition debris.” PALLETS CANNOT BE DISPOSED OF IN A MSW LANDFILL. Unpainted pallets may be ground for mulch and painted pallets may be used for boiler fuel. 12. All areas of the landfill where additional waste will not be placed on them for 12 months or more, but where final termination of disposal has not occurred, must be covered with a minimum of one foot of intermediate cover. 13. Facility staff send pictures on July 21, 2016 at approximately 8:30 am showing that working face in Phase 5 and the slope in Phase 4 had been covered on the evening of July 20, 2016.
