Dear Mr. Frost,
On October 19, 2015, Duke Energy notified the Division that the final placement of coal combustion
product occurred at the Marshall Steam Station FGD Landfill (Permit No. 1809-INDUS). With that
notification Duke Energy requested deference of closure activities. In a response from the Division dated
October 20, 2015, Duke received approval to defer closure activities and a list of expectations from the
Division. This letter serves as a request for an extension of 6 months to the October 1, 2016 deadline to
notify the Section of Duke Energy's determination on whether to expand the landfill or move towards
closure.
As discussed via phone conversation on September 20, 2016, uncertainty remains in regards to final
North Carolina Department of Environmental Quality (NCDEQ) ranking of the Marshall Steam Station
ash basin. The FGD Landfill at Marshall Steam Station has about 100,000 cubic yards of air space
remaining in Phase I in addition to Site Suitability for Phase II. Since ash basin ranking could affect the
construction timing for future expansion of the Marshall Steam Station Industrial Landfill No. 1 (Permit
No. 1812), Duke Energy would like to defer commitment of expansion or closure of the FGD Landfill
until further evaluation and progress has been made towards satisfying requirements of the North Carolina
General Statue 130A-309.213(d), added by House Bill 630.
Duke Energy intends to communicate progress of ash basin ranking and future Marshall Steam Station
landfill needs with the Division no later than April 1, 2017.
Duke Energy is committed to environmental stewardship and cooperation with the Division regarding the
operation, maintenance, safety, and integrity of all of its facilitates. The FGD Landfill will continue to be
properly maintained until a final decision is made. If there are any questions regarding this request,
