The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and
any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. The purpose of this visit was to determine the closure status of the facility. This permittee has been working with
the land/building owner to remove the waste from the property and vacate. Orbit had a contractor on-site to pump
the tanks/vessels.
2. During the site visit, it was determined that all waste had not been removed. The items in question (listed and
indicated in photographs below) were:
a) At least seven totes, most of which were labeled “ALCOA”, contained a dry granular waste material.
b) At least six drums that contained various unknown waste material.
c) The large digester vessel contained 20+ inches of sludge material.
d) One tank (process/holding) was not empty.
3. Discussions with the Compost & Land Application Branch indicate the facility has not requested renewal of the
Permit to Operate, which expired in November of 2015. As a result, all solid waste at the site must be removed and
transported to a permitted solid waste management facility within thirty days of receipt of this Report. Be sure to
retain copies of all receipts so as to properly document the transport thereof.
