ADDITIONAL COMMENTS
Carolina Power & Light Company, Roxboro Steam Electronic Plant, proposed construction of the structural fill
project in March 1992. The structural fill material was used to expand the foundation of the existing coal pile and is
located on the facility property, adjacent to the north side of the Roxboro Steam Plant.
1. On March 5, 1992 the Division of Solid Waste Management (now the Solid Waste Section Section) received
the written structural fill request from Carolina Power & Light Company. The projected size of the expansion
area was 18 inches by 1,000 feet by 450 feet which would utilize approximately 25,000 cubic yards of fly ash.
2. This structural fill was completed prior to the January 4, 1994 effective date of the 15A NCAC 13B .1700
Structural Fill rules. This structural fill was constructed under conditions outlined in Ash Permit No.
WQ0003604. Only ash from the Roxboro Plant was to be utilized. No ash was to be placed within one foot
of the season high groundwater table. Records of the activities were to be maintained by the facility.
3. The Coal Pile Storage Pad was being well maintained at the time of the inspection. No erosion or ponded
water was observed during the inspection.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

4. The structural fill is currently being used for its notified purpose. In the future if the structural fill is no longer
utilized for its intended purpose as a coal pile storage pad, per the requirements of 15A NCAC 13B .1705(j),
the structural fill shall be covered with a minimum of 12-inches compacted earth and an additional 6-inches of
surface soil capable of supporting native vegetation.
