OBSERVED VIOLATIONS:
15A NCAC 13B .1404(a) A site shall meet the following requirements at the time of initial permitting and shall continue
to meet these requirements throughout the life of the permit only on the property owned or controlled by the applicant or
by the landowner(s) at the time of permitting: (2) A 100-foot minimum buffer is required between all property lines and
compost areas for Type 3 and 4 facilities, 50-foot for Type 1 or 2 facilities.
Toxaway Grading Company, Inc. is in violation of 15A NCAC 13B .1404(a) in that waste was observed within 50 feet of
the property line near Highway 64.
In order to achieve compliance, within 30 days of receipt of this inspection report, Toxaway Grading Company, Inc. must
remove all waste and finished material within the 50-foot buffer required between all property lines.

ADDITIONAL COMMENTS
1. The facility does not accept material from the public and is only used by Toxaway Grading Company, Inc.
2. The entrance to the facility is secured by a locked cable.
3. The access road was constructed of gravel and was in good condition at the time of inspection.
4. Adequate access was provided between material stockpiles for firefighting access.
5. No unapproved material was observed onsite.
6. Unground material was stored approximately 25 feet from the property line on the north side of the facility near
Highway 64. All ground and unground material must be stored outside the 50-foot property line buffer.

7. It appeared that less than 6000 yds3 of material was on site at the time of inspection.

with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
