Side slopes around Phases 1-4 are scheduled to be reseed. 2. 15A NCAC 13B .0203(d): Not resolved. Corrective Measures in Progress. Side slopes around Phases 1-4 are scheduled to be reseeded. 3. 15A NCAC 13B.1626(11)(c): Resolved. Windblown litter in Phases 1-4 has been addressed. OBSERVED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on August 30, 2016 2. The facility is currently filling in Phase 5 of the landfill. 3. The Windblown litter issues in Phases 1-4 have been addressed. Minimal windblown litter was observed in Phase 5 at the time of inspection. 4. The working face was smaller and appeared that it would be able to be covered with an approved alternative daily cover at the time of inspection. 5. No unacceptable waste was observed on the working face at the time of inspection. 6. Facility staff have added additional soil to slopes in Phase 2 to repair erosion issues. 7. Slope drains and a berm have been installed in Phase 2. Facility staff stated that additional slopes drains are going to be added as necessary to control storm water. 8. Slight erosion is has occurred in Phase 3 of the landfill. Facility staff have stockpiled soil above the area in preparation for repairing the areas of concern. 9. Facility staff were in the process of repairing rill erosion on the slopes of Phase 4 at the time of inspection. 10. The County is currently in the process of awarding a contract for adding one foot of intermediate cover and seeding phases 1-4 as well as matting portions of those areas. 11. Significant progress has been made to address the issues noted in the August 3, 2016 Notice of Violation. Facility staff have made substantial progress in repairing the erosion issues and preparing the slopes in Phases 1-4 for intermediate cover as well as correcting the windblown litter issues. When intermediate cover is added and groundcover sufficient to restrain erosion is established the outstanding issues can be resolved. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
