STATUS OF PAST NOTED VIOLATIONS:
15A NCAC 13B .1406(g)(3)(A): Resolved. The Town of Tryon submitted the Yard Waste Notification to the Solid
Waste Section.
15A NCAC 13B .1406(6): Resolved. The Town of Tryon removed the plastic bags and MSW from the yard waste area.
OBSERVED VIOLATIONS:
None
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on August 29, 2016.
2. The facility is located at the Town of Tryon Waste Water Treatment Plant.
3. The facility is secured by a gate at the entrance to the facility.
4. The road was constructed of gravel and was in good condition at the time of inspection.
5. The bagged leaves that were noted during the July 7, 2016 inspection have been removed from the yard waste
area.
6. A small amount of unacceptable material (plastic bag) was observed in the yard waste area, please remove this
from material and dispose of it properly.
7. Plastic pipe, metal strapping, fabric, and wood was observed at the beneficial fill area located to the south of the
yard waste area. Per 15A NCAC 13B .0562 Beneficial Fill, the only fill material acceptable is inert debris
consisting of unpainted concrete, block, brick, uncontaminated soil, rock, gravel and used asphalt.
Ensure all unapproved material is removed from this area so it is not incorporated into the fill.
8. Adequate access was provided for firefighting equipment.
9. It appeared that less than 6000 yds3 of material was on site at the time of inspection.
