North Carolina Solid Waste Permit SDTF-34-05, Operating Permit Condition #3 states in part: “The method for controlling odors described in the approved application for this permit must effectively control all odors created by the operation of this facility as required by 15A NCAC 13B .0841(g)”. On May 24, 2016, Carolina Resource Recovery for Liberation Capital BG Winston-Salem, LLC was in violation of A NCAC 13B .0841(g) and North Carolina Solid Waste Permit SDTF-34-05, Operating Condition #3 because odors were observed by Forsyth County Office of Environmental Assistance Staff between 9:10 AM and 9:15 AM near the entrance to the facility on Palmer Road and at City of Winston-Salem Fire Station No. 5 located at 771 Palmer Lane. On May 24, 2016, a Notice of Violation (NOV) was issued which required a corrective action plan be submitted to the Division of Waste Management, Solid Waste Section within 30-days of receipt of the NOV, identifying the source of the odor emissions and a proposed remedy. The plan must be implemented within 60-days of receipt of this Notice of Violation. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 On June 9, 2016, a revised “Odor and Vector Control Plan” (plan) was submitted to the Division. The plan was approved by the Division. On July 15, 2016 an inspection of the Carolinas Resource Recovery (CRR) facility was conducted. As part of the inspection, the Palmer Lane, Clemmonsville Road and Cassell Street were patrolled and no objectionable odors observed. Based on information from the facility and inspection, it appears that the stipulations contained in the NOD have been met. The Notice of Violation issued on May 24, 2016 is resolved. OBSERVED VIOLATIONS: N/A ADDITIONAL COMMENTS On July 15, 2016 at approximately 3:15 PM, no objectionable odors were observed on Palmer Road, Clemmonsville Road and Cassell Street. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
