STATUS OF PERMIT: Yard Waste Facility Notification application received by the SWS Yard Waste Facility Notification approval letter issued by the SWS Yard Waste Facility Notification expires on June 1st of each year PURPOSE OF SITE VISIT: Comprehensive Inspection (to ensure that the yard waste facility notification is in compliance with 15A North Carolina Administrative Code (NCAC) 13B .1404(a)(1)-(10), 13B .1406, and the requirements as stated on the yard waste facility notification application and the corresponding approval letter). STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On August 26, 2016, John Patrone met with Christopher Mcghee, Trent Satterfield, and Heather Fuller to conduct a comprehensive inspection of Gorilla Materials, Inc. YWN on Mount Hermon Church Road in Durham, Orange County. 1. The yard waste notification (YWN) is located at Gorilla Materials, Inc. which specializes in concrete and asphalt recycling. 2. The site is primarily dedicated to concrete and used asphalt storage and crushing and land clearing debris (LCD) storage and grinding. 3. Gorilla Materials, Inc. grinds LCD. It does not compost material. 4. The designated area used for the YWN is < 2 acres. 5. The facility maintains records of the amount of LCD received. Monthly records for June, July, and August (to date) 2016 were verified. 6. It is estimated that there is ~ 4,500 yd3 of LCD on site. 7. The facility is currently grinding LCD and will screen piles of mixed LCD and soil. 8. As material is ground it is placed in trailers and hauled-off/sold or placed in mulch storage bins. Mulch is not stored at the designated YWN processing area. 9. Mulch storage bins are located adjacent to the office. 10. Ensure only high carbon:nitrogen ratio material is accepted. 11. If high nitrogen:carbon ratio material is accepted it must be composted. 12. Ensure processed and unprocessed material at the YWN processing area is less than 6000 yd3 quarterly. 13. Adequate fire lanes are maintained. 14. Access roads are of all-weather construction. 15. The facility is secured by a locked gate. 16. The facility has a proper sign. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
