The land clearing and inert debris (LCID) landfill is known as the Phillippie LCID landfill [Carden Road]. 2. The facility has not brought any LCID material on site as of the date of this inspection. 3. Mr. Phillippie stated, in a recent conversation, that he does not plan to operate the LCID landfill at this time but would like to maintain the notification. 4. Currently, the area designated as the [future] LCID landfill is used for agriculture. 5. If the LCID landfill is operated, it is suggested that edge of waste markers are installed to delineate the fill area. 6. Per 15A NCAC 13B .0564(9)(a), “The facility shall meet the following buffer requirements: 50 feet from the waste boundary to all surface waters of the state as defined in G.S. 143-212.” 7. Per 15A NCAC 13B .0564(9)(b), “The facility shall meet the following buffer requirements: 100 feet from the disposal area to property lines, residential dwellings, commercial or public buildings, and wells.” 8. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 9. Side slopes should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed. 10. Per 15A NCAC 13B .0566(10), “Surface water shall be diverted from the working face and shall not be impounded over waste.” 11. Open burning of solid waste is prohibited. 12. If the LCID landfill is operated, an all-weather access road shall be constructed. 13. If the LCID landfill is operated, the site shall be secured from unauthorized entry. The access road may be secured by gate, chain, fence, berm, etc. 14. If the LCID landfill is operated, a sign shall be posted at the entrance with contact name and phone number. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
