Dear Ms. Cook:
On July 29, 2016, Connie S. Wylie, representing the State of North Carolina, Division of Waste
Management Solid Waste Section, inspected the above referenced facility for compliance with
North Carolina solid waste statutes and rules. The following violations were noted:
A. 15A NCAC 13B .0838(a)(18) Approved nutrient management plans shall be followed.
Excessive weeds & tall vegetation over the entire disposal field. This was previously noted on
the last audit of 10/19/2015. Site has not been harvested in a timely fashion or weeds
controlled as per the approved nutrient management plan. Land application has been
occurring.
B. 15A NCAC 13B .0838(a)(2) Each site shall be posted with “No Trespassing” signs. Access
roads or paths crossing or leading to the disposal area shall be posted “No Trespassing” and a
legible sign of at least two feet by two feet stating “Septage Land Application Site” shall be
maintained at each entrance to the land application area.

The above violations may have or can compromise the facility’s ability to ensure protection of
the public health and the environment and thus require remedial action on behalf of the facility
in order to maintain compliance with 15A NCAC 13B .0838(a)(2&18). In order to resolve these
issues, S & B Maintenance LLC must take the following actions:
1. Contact your local extension agent/regional agronomist in regards to weed control.
Harvest the site in regards to the 30 day waiting period after the last septage
application. Establish the cover crop as per the approved nutrient management plan so
that land application may occur this winter.
2. Post the required “No Trespassing” & “Septage Land Application Site” signs at the front
entrance to the permitted site.
3. S & B Maintenance LLC shall provide a written certification with supporting
documentation on company letterhead confirming the corrective actions have been
completed. Include in this certification any actions taken to prevent these violations from
occurring in the future. Mail this certification to Connie S. Wylie, NCDEQ, Division of
Waste Management, Fayetteville Regional Office, 225 Green Street, Suite 714,
Fayetteville, NC 28301 by the October 7, 2016.
The violations listed above were observed by Section staff and require action on behalf of the
facility in order to come into or maintain compliance with the Statutes, Rules, and/or other
regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A‐22,
an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid
Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the
N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management
facility or a solid waste collection service and any such further relief as may be necessary to
achieve compliance with the North Carolina Solid Waste Management Act and Rules.
Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct
a follow‐up inspection(s) to verify that the facility has completed the requirements of this Notice
