Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The middle tank (6,000 gallons per the current permit) has a significant rust hole in the side of the tank and shall not be used for septage detention per Rule .0841(c) as all SDTF containers shall be structurally sound. 2. The 21,000 gallon storage tank (covered under the current permit) appeared structurally sound & is available for septage detention. The other tank on site is not level, not covered under the current permit and shall not be used for septage detention. 3. Post the required “No Trespassing” sign at the site entrance. 4. No spills or leaks noted. No vectors or odors. 5. It appears that septage is being transferred to/from the detention facility in a safe and sanitary manner. 6. It appears that the approved setbacks are being met. 7. The access road is adequate. 8. The required 5’ cleared radius is present around the tanks at this time.
