PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0566(2) states “The facility shall only accept those solid wastes which it is permitted to receive. Whitmire LCID is in violation of 15A NCAC 13B .0566(2) by accepting unpermitted materials. On August 22, 2016 metal roofing, fabric, and coir erosion control matting was observed on the working face of the landfill. To achieve compliance, Whitmire LCID must immediately remove all unapproved materials from the LCID landfill and dispose of properly. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on August 22, 2016. 2. The facility was secured by a gate at the entrance and was locked at the time of inspection. 3. The roads in the facility were constructed of gravel and were in good condition at the time of inspection. 4. No erosion was observed at the time of the inspection. 5. Adequate soil cover must be applied monthly or when the disposal area reaches one acre in size. 6. Unapproved material was observed on the working face of the landfill. Coir erosion matting, metal roofing, and fabric was observed. The facility is only approved to accept land clearing waste, untreated wood, yard trash, unpainted concrete, brick, block, and used asphalt. Please see observed violations section of this report. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
