STATUS OF PAST NOTED VIOLATIONS:
15A NCAC 13B .0203(d): Resolved. Riverside Stump Dump at Mills River installed boundary markers as required by
permit condition #10. Riverside Stump Dump at Mills River installed a sign providing site information including the
permit number, prohibited materials, and emergency contact information. Therefore, the violations are resolved.
OBSERVED VIOLATIONS:
15A NCAC 13B .0203(d) states: “By receiving solid waste at a permitted facility, the permittee(s) shall be considered to
have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit to Operate 4507-
TP, Attachment 3 Conditions of Operating Permit, #8 states that “All wood and processed materials must be
maintained at least 50 feet from the property boundary lines and from the onsite surface water stream.” Riverside
Stump Dump was in violation of 15A NCAC 13B .0203(d) in that saw logs were observed within in the 50-foot buffer
during the August 16, 2016 inspection. On August 22, 2016 the saw logs had been moved from the buffer. Therefore,
the violation is resolved.

ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on August 16, 2016 and August 22, 2016.
2. The facility is permitted to receive stumps, untreated and unpainted wood, and land clearing debris.
3. The facility is secured by gates at both entrances.
4. Signage has been installed at the entrance of the facility providing site information including the permit number,
prohibited materials, and emergency contact information.
5. Permanent buffer markers have been installed on the north and west side of the site. Some of the buffer
markers have an offset because the 50’ buffer is within the entrance road.
6. All ground material appeared to be outside 50-foot buffer around the facility. A stockpile of “saw logs” were
being stored in the buffer area during the August 16, 2016 inspection. All material, (ground and unground)
cannot be stored in the 50-foot buffer. On August 22, 2016 the “saw logs” had been removed from the buffer
area.
7. Buffer markers have been installed to delineate the stream buffer on the east side of the property. All material
was stored outside the stream buffer area at the time of inspection.
8. The ditch line between the mulch and access road has been cleaned.
9. The access road on the east side of the facility has been upgraded. The facility removed the mulch on the access
road within the buffer area and replaced it with gravel to help prevent mulch from entering the stream buffer
area.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
