Compliance Inspection Report
S & S Septic Tank Pumping
NCS‐00282

Dear Mr. Turner:
On August 12, 2016, Connie S. Wylie and Chester R. Cobb, representing the State of North
Carolina, Division of Waste Management Solid Waste Section, inspected property owned by
Southern Diversified Timber LLC (PIN 0164.00‐25‐6895.000) off of Buck Ridge Road, Clarendon
for compliance with North Carolina solid waste statutes and rules. Mr. John G. Turner was present
and represented S & S Septic Tank Pumping during this inspection. The following violation was
noted:
A. N.C.G.S. 130A‐291.1(d) Septage shall be treated and disposed only at a wastewater
system that has been approved by the Department under rules adopted by the Commission or
by the Environmental Management Commission or at a site that is permitted by the
Department under this section. A permit shall be issued only if the site satisfies all of the
requirements of the rules adopted by the Commission.
On three separate occasions (August 8th, 9th & 11th) the Septage Management Firm “S & S Septic
Tank Pumping” discharged septage onto the ground surface at two discharge locations on
property owned by Southern Diversified Timber LLC (PIN 0164.00‐25‐6895.000) off of Buck
Ridge Road, Clarendon. The discharge of septage onto this property owned by Southern
Diversified Timber LLC, which is neither a currently permitted septage disposal site nor a
wastewater treatment system permitted to receive septage, is a violation of N.C.G.S. 130A‐
291.1(d).

Based upon the foregoing, S & S Septic Tank Pumping shall come into compliance (within 7
business days of receipt of this letter) with all requirements of the regulations in N.C.G.S. 130A‐
291.1(d) by completing the following:
1. Completely remove all septage and contaminated material (vegetation and soil) from
the two discharge areas and properly dispose of this waste material at a MSW landfill.
Hydrated lime shall be spread on the discharge areas after the cleanup has been
completed. Please provide this office with the landfill receipts to document proper
disposal of the waste material.
2. Provide a copy of all truck pumping logs for S & S Septic Tank Pumping for the time
frame of January 1, 2016 until now.
3. Septage pumped by S & S Septic Tank Pumping shall only be discharged at approved
discharge locations per the Septage Management Firm Permit #NCS‐00282 and
submitted disposal authorizations. Provide disposal authorizations for any wastewater
treatment plant to be utilized.
S & S Septic Tank Pumping shall provide a written certification with supporting documentation
on company letterhead confirming the noted compliance schedule has been completed. Include
in this certification any actions taken to prevent these violations from occurring in the future.
Mail this certification to Connie S. Wylie, Division of Waste Management, Fayetteville Regional
Office, 225 Green Street, Suite 714, Fayetteville, NC 28301 within 7 business days of receipt of
this letter.
The violation listed above was observed by Section staff and require action on behalf of the
facility in order to come into or maintain compliance with the Statutes, Rules, and/or other
regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A‐22,
an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid
Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the
N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management
facility or a solid waste collection service and any such further relief as may be necessary to
achieve compliance with the North Carolina Solid Waste Management Act and Rules.
Please keep me informed of your progress in this matter. Solid Waste Section staff will conduct
a follow‐up inspection to verify that the facility has completed the requirements of this Notice of
Violation.
