Shelby, NC 28150 PARTICIPANTS: Troy Harrison, Composting & Land Application Branch STATUS OF PERMIT: Active Issued: 3/15/2013 Expires: 10/1/2017 PURPOSE OF SITE VISIT: Routine Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0841 (i) states: The area around tanks shall be free of debris and vegetation to allow for access and inspection for a distance of at least 5 feet. On July 27, 2016, Leonard McSwain Septic Tank was in violation of 15A NCAC 13B .0841 (i) for failure to keep the area around the septage detention tanks free of vegetation to allow for access and inspection for a distance of at least 5 feet. In order to come into compliance, the vegetation must be cleared to a distance of 5 feet by August 22, 2016. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The Septage Detention and Treatment facility (SDTF) consisted of one 10,000 gallon above ground steel tank for storage and treatment of domestic septage. 2. All photographs were taken by Troy Harrison on July 27, 2016. 3. Set-back/buffer requirements appear to have been met. 4. Appropriate signage (No Trespassing signs) is posted for the site. 5. All weather roads are maintained for access to the site. 6. The tanks appeared to be structurally sound. Vegetation was observed growing around the tank. State regulation require that the area around the tank be free of debris and vegetation to allow for inspection and access for a distance of at least 3 feet. This was also observed during the inspection on October 30, 2016. 7. The area around the detention and treatment area was found to be free of spills and debris. 8. No odors observed in the area of the detention and treatment area.
