A) The approved nutrient management plan states: “A 30-day minimum waiting period will be observed after septage applications before grazing and/or forage harvesting occurs.” On November 17, 2015, Page’s Septic Tank Cleaning was in violation of 15A NCAC 13B .0838 (a) (18) because cattle were observed on Field B which was actively being used for septage application, therefore, the approved Nutrient Management Plan was not being followed. In order to achieve compliance, Page’s Septic Tank Cleaning was required to: a. Immediately restrict cattle from grazing on Field B, and b. Submit a written plan describing actions that will be taken to prevent cattle grazing on a septage land application field while it is being actively used. Page’s Septic Tank Cleaning was in violation of 15A NCAC 13B .0838 (a) (18) because the tall fescue and/or orchard grass was less than 80% of Field C, therefore, the approved Nutrient Management Plan was not being followed. In order to achieve compliance, Page’s Septic Tank Cleaning was required to: a. Follow the approved management plan for re-seeding and/or inter-seeding. The dates for this activity is listed in the plan as “between February 15 and March 31”, and was given the option to contact the Davie County Cooperative Extension at 336-753-6100, for advice on field maintenance and weed control. The Solid Waste Section received from you a “Notice of Ceased Operation of a Septage Land Application Site” with a closure date of August 1, 2016. A follow-up inspection will need to be conducted to verify that septage land application has ceased in order to resolve the violations. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 3 ADDITIONAL COMMENTS 1. All photographs were taken by Troy Harrison on June 15, 2016. 2. The Septage Land Application Site consists of Field B (5.7 acres) and Field C (5.1 acres) for a total of 10.8 usable acres. 3. The site is permitted for land application of domestic septage (including portable toilet waste) and grease septage. 4. The site had accessible all-weather roads to the septage land application field covered under the permit. 5. Appropriate signage was displayed at the site. 6. All fields had disposal area boundaries that were delineated with permanent markers. It was difficult to determine the location of the markers due to the growth of thistles in the field. 7. No recent land applications in Field B was were observed. It also appeared that the vegetation on this field is routinely grazed. Cattle were located in a nearby field but had access to this field. It appears that this field is past the 80% limitation. This field was filled with blooming thistle plants. Fields cannot be used for land application unless an adequate tall fescue and orchard grass crop is established and maintained. This field is approved for the planting of tall fescue and orchard grass and requires re- seeding or inter-seeding when the stand density falls below 80%. The field also was accessible to grazing cattle (through two open gates) and appeared to be currently being grazed. The Nutrient Management Plan (Plan) requires a 30-day minimum waiting period to be observed after septage applications before grazing and/or foraging harvesting occurs. This field is approved for the planting of tall fescue and orchard grass and requires re-seeding or inter-seeding when the stand density falls below 80%. It appears that this field is past the 80% limitation and needs re-seeding. Fields cannot be used for land application unless an adequate tall fescue and orchard grass crop is established and maintained.
