STATUS OF PAST NOTED VIOLATIONS:
None
OBSERVED VIOLATIONS:
1. 15A NCAC 13B .1626(4)(a)(ii) states: Owners or operators of all MSWLF units must ensure that: The
concentration of methane gas does not exceed the lower explosive limit for methane at the facility property
boundary.
During the review of the methane monitoring data during the August 10, 2016 inspection it was found that the lower
explosive limit for methane had been exceeded at MP-4 on multiple dates. Therefore, Henderson County is in
violation of 15A NCAC 13B .1626(4)(a)(ii) in that the lower explosive limit for methane has been exceeded at the
property boundary. Henderson County has notified the Section per 15A NCAC 13B .1626(4)(c)(i) when exceedances
have occurred.

To achieve compliance, Henderson County must immediately take all necessary steps to ensure protection of human
health and submit a Landfill Gas Remediation Plan within 60 days of the detection date per 15A NCAC 13B
.1626(4)(c)(iii) to the Solid Waste Section for review. This documentation should be submitted to:

ADDITIONAL COMMENTS
1. All photos were taken by Lee Hill on August 10, 2016.
2. Heavy rain occurred during the field inspection of the facility.
3. The facility stopped receiving construction and demolition waste on June 30, 2008.
4. Groundwater monitoring reports for March 2013, September 2013, March 2014, September 2014, March 2015,
September 2015, and March 2016 were available for review. All reports had exceedances reported above the
2L standard.
5. Methane monitoring is being conducted quarterly and records were available for review. Compliance well MP-
4, located on the west side of the facility has exceeded the LEL on multiple occasions. During the latest
monitoring event which occurred on June 16, 2016 the methane level at MP-4 was recorded at 9.5%. On June
20, 2016 the Section was notified of the latest methane exceedance. Please see Observed Violations section of
this report.
6. The landfill has converted from active landfill gas collection system to a passive system.
7. Bubbling which appears to be landfill gas was observed on a bare spot located on the northwest side slope of the
landfill in the general vicinity of MP-4. This kind of activity is indicative of a landfill gas collection system that
in not operating optimally.
8. On October 17, 2013 the Section approved Landfill Gas Remediation Plan – Phase 1 and on January 21, 2015
approved Landfill Gas Remediation Plan – Phase 2 to address landfill gas exceedances at MW-5 and TR-3.
9. On May 7 and 8, 2015, three landfill gas wells (MP-7, MP-8, and MP-9) were installed per the approved
Landfill Gas Remediation Plan – Phase 2. Existing landfill gas well TR-1 was also decommissioned at that
time.
10. Good vegetative cover was observed on the landfill slopes and top. The landfill had been recently mowed at the
time of inspection and no woody vegetation was observed.
11. Edge of waste markers are installed.
12. Groundwater monitoring wells were locked and clear of vegetative growth.
13. A new stormwater grate has been installed on the southeast side of the landfill to help with stormwater
management.
14. Facility staff are in the process of re-grading the access road on the northwest side of the landfill.
15. No areas of significant settling were observed at the time of inspection.
16. An injection well was installed on March 8-9, 2016 to super aerate the groundwater.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
