OnJuly20,2016,LeeHill,representingtheStateofNorthCarolina,DivisionofWaste
ManagementSolidWasteSection(Section),inspectedtheabovereferencedfacilityfor
compliancewithNorthCarolinasolidwastestatutesandrules.JeffBrookshireandDwayneSmith
werepresentandrepresentedTransylvaniaMunicipalSolidWasteLandfillFacilityduringthis
inspection.Thefollowingviolationswerenoted:

A.15ANCAC13B.1626(2)(a)states“ExceptasprovidedinSubͲItem(b)ofthisItem,the
ownersoroperatorsofallMSWLFunitsmustcoverdisposedsolidwastewithsixinches
ofearthenmaterialattheendofeachoperatingday,oratmorefrequentintervalsif
necessary,tocontroldiseasevectors,fires,odors,blowinglitter,andscavenging.”
TransylvaniaCountyisinviolationof15ANCAC13B.1626(2)(a)byfailingtocoverall
wasteattheendofeachworkingday.OnthemorningofJuly20,2016theworkingface
ofthePhase5wasobservedpartiallycoveredwithatarp.Wasteontheeastsideofthe
workingfaceofPhase5wasobserveduncovered.Wastewasalsoobserveduncovered
onthewestsideslopeofPhase4.

B.15ANCAC13B.0203(d)statesinpart:“…byreceivingsolidwasteatapermittedfacility,
thepermittee(s)shallbeconsideredtohaveacceptedtheconditionsofthepermitand

sixinchesofsoil,oratarp(previouslyapprovedasanalternativedailycover).Whena
tarpisused,theminimumofsixinchessoilcoverwillbeplacedonceaweek.Thecover
soilplacedweeklyshallbecompactedwithminimumoftwopasseswiththecompactor.
Wastemaybecoveredmorefrequentlythanonceperdayifnecessarytocontrolfires,
odors,orblowinglitter.”

TransylvaniaCountyisinviolationof15ANCAC13B.0203(d)byfailingtocoverallwaste
attheendofeachworkingday.OnthemorningofJuly20,2016theworkingfaceofthe
Phase5wasobservedpartiallycoveredwithatarp.Wasteontheeastsideoftheworking
faceofPhase5wasobserveduncovered.Wastewasalsoobserveduncoveredonthe
westsideslopeofPhase4.

C.15ANCAC13B.1626(11)(c)Methodssuchasfencinganddikingshallbeprovidedwithin
theareatoconfinesolidwastesubjecttobeblownbythewind.Attheconclusionof
eachdayofoperation,allwindblownmaterialresultingfromtheoperationshallbe
collectedandreturnedtotheareabytheowneroroperator.

windblownmaterialandreturnittotheareaattheconclusionofeachdayofoperation.
WindblownlitterwasobservedtheinthePhase5cellandontheslopesofPhase4onthe
morningofJuly20,2016.

necessaryalongtheaccessroadandaroundtheactivedisposalarea.”

TransylvaniaCountyisinviolationof15ANCAC13B.0203(d)byfailingtocollectall
windblownmaterialandreturnittotheareaattheconclusionofeachdayofoperation.
WindblownlitterwasobservedtheinthePhase5cellandontheslopesofPhase4onthe
morningofJuly20,2016.

Basedupontheforegoing,TransylvaniaMunicipalSolidWasteLandfillFacilityshallcomeinto
compliancebythedateindicatedbelowwithallrequirementsoftheregulationsin15ANCAC
13B.1626(2)(a),15ANCAC13B.0203(d),15ANCAC13B.1626(11)(c)bycompletingthefollowing:

Theviolation(s)listedabovewereobservedbySectionstaffandrequireactiononbehalfofthe
facilityinordertocomeintoormaintaincompliancewiththeStatutes,Rules,and/orother
regulatoryrequirementsapplicabletothisfacility.BeadvisedthatpursuanttoN.C.G.S.130AͲ22,
anadministrativepenaltyofupto$15,000perdaymaybeassessedforeachviolationoftheSolid
WasteLaws,Regulations,ConditionsofaPermit,orOrderunderArticle9ofChapter130Aofthe
N.C.GeneralStatutes.Further,thefacilityand/orallresponsiblepartiesmayalsobesubjectto
enforcementactionsincludingpenalties,injunctionfromoperationofasolidwastemanagement
facilityorasolidwastecollectionserviceandanysuchfurtherreliefasmaybenecessaryto
achievecompliancewiththeNorthCarolinaSolidWasteManagementActandRules.
