Foushee PO Box 733 Pittsboro, NC 27312 PARTICIPANTS: John Patrone, Environmental Senior Specialist - Solid Waste Section (SWS) William Ralph Foushee, Owner/Operator - Foushee Grading LLC LCID Landfill (via telephone 08/11/16) STATUS OF PERMIT: Update Land Clearing and Inert Debris Landfill Notification recorded with the Chatham County Register of Deeds January 24, 2014 Current status of the Land Clearing and Inert Debris Landfill Notification is OPEN PURPOSE OF SITE VISIT: Comprehensive Inspection (to ensure that the notified land clearing and inert debris (LCID) landfill is in compliance with 15A North Carolina Administrative Code (NCAC) 13B .0563, .0564, and .0566) STATUS OF PAST NOTED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 OBSERVED VIOLATIONS: None ADDITIONAL COMMENTS On August 11, 2016, John Patrone conducted a comprehensive inspection of the Foushee Grading LLC LCID Landfill on Moncure Pittsboro Road in Moncure, Chatham County. 1. The Foushee Grading LLC LCID Landfill is a notified land clearing and inert debris (LCID) landfill. 2. The LCID landfill is < 2 acres. The landfill boundary is designated by white PVC [vertical] pipe. 3. The LCID landfill is not open to the general public. Foushee Grading LLC personnel access the site. 4. Mr. Foushee stated that land clearing debris (LCD) on site has been received within the last month. 5. The facility operates a narrow working face along the side slope. Material atop the landfill is covered with soil. 6. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 7. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 8. Side slopes should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed. 9. There was no indication of erosion or runoff. 10. Northward of the landfill is a soil borrow pit/soil storage area. 11. The facility has two sediment basins on the eastside of the disposal area. 12. The facility has an all-weather access road. 13. The facility is secured by a mechanical/electronic gate [passcode needed]. 14. The entrance drive to the facility is at [mailbox] 4900 Moncure Pittsboro Road. 15. The facility has a sign. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
