PURPOSE OF SITE VISIT:
Partial Inspection

STATUS OF PAST NOTED VIOLATIONS:

1. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0542(l)(4) cited for failure to capture
leachate or to treat it prior to discharge. Results of the soil sampling were presented to the Solid Waste
Section. After review, a determination was made by Hydrogeologist Jaclynne Drummond that no additional
environmental assessment associated with the leachate release would be required at this time. Any measures
implemented at the C&D landfill that would prevent future leachate releases must be inspected in order to
resolve this violation. Due to time constraints, no inspection of the C&D landfill was made on this date.

2. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0542(f)(1) cited for failure to apply
adequate cover to waste at the C&D landfill. No inspection of the C&D landfill was made on this date.

3. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .1626(2)(a) cited for failure to adequately
cover waste at the MSW landfill. Mr. Sink indicated that reseeding of the MSWLF had taken place on July
15, 2016. However, the grading work and new cover application that were a part of the reseeding process
throughout the facility were mostly destroyed during several heavy rain events, the last of which occurred
July 30 and 31, 2016. Mr. Sink stated that cover and repairs were currently underway, but the wet, muddy
conditions were greatly impeding efforts. A great deal of uncovered waste was observed at various areas on
the landfill slopes and on top surrounding the working face. Although additional grading and slope repairs
may be hindered or delayed by the weather, all exposed waste must be covered immediately.

4. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B. 1626(7)(a) cited for failure to prevent silt
from leaving the MSWLF facility. Significant areas of erosion were observed at the MSWLF during this
inspection due to the recent heavy rains. Mr. Sink stated that additional cover, regrading and reseeding
would resume once conditions improved. Compliance will be achieved once vegetative cover is established
on the slope facing the new cell construction.

5. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B. 1626(7)(b) cited for failure to prevent on-
site erosion. Due to recent heavy rain events, additional cover, regrading and reseeding of the slope facing
new cell construction and on some of the eroded areas of the remaining slopes of Phase 2 of the MSW
landfill will be required again. Mr. Sink stated that slope repairs and regrading will be completed as quickly
as possible so that reseeding can be scheduled.

6. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B. 1626(7)(c) cited for failure to provide for a
vegetative cover sufficient to restrain erosion within 30 working days or 120 calendar days of completion of
any phase of MSWLF development. Thus far, efforts at establishing a stable vegetative cover have not been
effective. Evidence of additional erosion was observed, and most of the sparse vegetative cover had been
washed away during recent heavy rains. Mr. Sink advised that reseeding would take place as quickly as it
could be scheduled, weather permitting.

OBSERVED VIOLATIONS:
No additional violations were observed during this inspection.

ADDITIONAL COMMENTS

1. Due to time constraints, the inspection included only the MSW landfill area, with focus on the slopes and working
face of the active landfill.
2. A significant amount of uncovered waste was observed on the side slopes that had likely been the result of erosion
caused by recent heavy rain events. Immediately cover all exposed waste.
3. Access roads are of all-weather construction. Access to the working face had been washed out and rain damaged in
spots. Repairs are needed in order to ensure safe lanes of travel for landfill traffic.
4. The working face of the MSW landfill was compact and had been configured to match the final grades of the active
cell. Areas of uncovered waste were observed surrounding the working face. Immediately cover all exposed waste
and ensure that all waste is covered at the end of each working day.
5. Mr. Sink stated that the remaining capacity of the active cell is limited to a small area across the top of the landfill,
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

and that he anticipated the available airspace would be full within two weeks.
6. Areas surrounding the MSWLF appeared to be in need of maintenance. Tall weeds and scrub brush were observed
throughout the facility, especially along access roadways. Mowing and regular maintenance of the facility may
assist in the collection of windblown litter. Ensure that all windblown trash is collected throughout the facility at the
end of each working day, including areas surrounding the scale house and access roads.
