OBSERVED VIOLATIONS: 1) Access road is not being maintained. Deep potholes present at several locations throughout the access road. This is a violation of Rule .0838 (a) (3) that states "Each site shall have an all weather access road." 2) The fields are not being maintained. This is a violation of Rule .0838(a)(18) that states “Approved nutrient management plans shall be followed.” Your nutrient management plan is written for common bermudagrass overseeded in rye or ryegrass. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Access road still has deep potholes in multiple areas. 3. Fences that serve as markers were up. 4. No evidence of any recent applications to the site. 5. Fields have not been maintained and weeds have grown up in the fields. 6. No objectionable odors noticed. 7. No change noticed with any of the setbacks. 8. No activity noticed on the fields. Pump truck still broke down is along the path near Hwy 903. Only one cow noticed at the site today. 9. SITE IS NOT IN COMPLIANCE. SITE CLOSED TO ANY SEPTAGE DISPOSAL. Fields are not being maintained.
