The Property is also subject to a Notice of Residual Petroleum ("NORP") required as part of a No Further Action Determination issued by DENR's Underground Storage Tank ("UST") Section. Cherokee Southline seeks to resolve conflicts between these regulatory requirements through cancellation of the NORP. On December 20, 2001, DENR's UST Section issued a No Further Action Determination for a UST release at the Property (Incident# 15771). As part of the closure, a NORP was placed in the chain of title of the Property (Attachment A). The NORP was recorded with the Mecklenburg County Register of Deeds on January 15, 2002. The NORP includes perpetual land use restrictions limiting the Property to industrial/commercial uses only and prohibiting groundwater use as a water supply. The Brownfields Agreement was executed and recorded on July 13, 2011. The Brownfields Agreement states that "underground water at the Brownfields Property may not be used for any purpose without written approval of DENR," which is consistent with the groundwater use restriction in the NORP. The Brownfields Agreement also states that "no use may be made of the Brownfields Property other than mixed commercial and high density residential use, with associated parking and landscaped areas, without DENR's prior written approval," which conflicts with the industrial/commercial land use restriction in the NORP. The presence of conflicting requirements between the Brownfields Agreement and the NORP limits development potential and creates confusion for future owners, lenders and title insurers of the Property. Further, the current land use restrictions contained in the Brownfields Agreement are sufficient to maintain the level of protection appropriate for the allowable uses on the Property. Assessment results from 2001 and 2014 are attached for your review (Attachments Band C, respectively). Cherokee Southline hereby requests that DENR cancel the NORP for the Harris Tire property. All future uses at the property should be governed solely by the land use restrictions in the Brownfields Agreement. This Phase I LSA addresses impacts related to one fonner 2,000-gallon No. 2 fuel oil underground storage tank (UST). The date of UST installation is estimated to be 1956 which is prior to purchase by the current property owner in 1974. This UST has reportedly been inactive since the change of ownership in 1974. The UST was used for on-site heating and was a non- regulated tank. The UST was removed from the Harris site in April 1995 by Jones & Frank, with soil sampling and closure report activities conducted by TERRAINE, Inc. During the removal, petroleum odors were noted in the soils and petroleum impacted soils were removed. The final excavation area, after removal of the UST and impacted soils, had dimensions of 17 ft by 8 ft by 12 ft deep. Although impacted soils were noted to remain in the bottom of the tank basin, 12 fi was the maximum reach of the equipment used during removal activities. According to the TERRAINE report, 60 tons of impacted soils were removed from the UST excavation area and stockpiled on-site for later treatment/disposal. TERRAINE, Inc. collected two bottom samples (T-1 and T-2) from the center line of the tank at a reported depth of 11 ft . Samples T-1 and T-2 were analyzed for total petroleum hydrocarbons - gasoline range organics (TPH-GRO) and total petroleum hydrocarbons -diesel range organics (TPH-DRO). Analytical results of the soil samples indicated up to 270 mg/kg TPH-GRO and up to 4, 100 mg/kg TPH-DRO. These results exceed the North Carolina Department of Envirorunent and Natural Resources (NCDENR) action level of 10 mg/kg for TPH-GRO and TPH-DRO. 1 \aaa.mastcr-projccu\h.a.-ris tire co\h1c..Ql\ph llu.rcpon doc Hart & Hickma11, PC I I I I I I I I I I I I I I I I I I I Results of analysis of the soil sample indicated the presence of extractable petroleum hydrocarbon (EPH) and volatile petroleum hydrocarbon (VPH) fractions as well as low concentrations of petroleum-related volatile and semi-volatile organic compounds. Of the compounds detected, VPH CS to C8 aliphatics, total C9 to C22 aromatics, and naphthalene were present above soil to ground water Maximum Soil Contaminant Concentrations (MSCCs). Of these compounds, total C9 to C22 aromatics also exceeded its residential direct contact MSCCs. No detected compounds exceeded industrial/commercial direct contact MSCCs. The MW-1 boring was completed as a monitor well to a depth of 25 ft, and a ground water sample was collected from the well and submitted for laboratory analysis. No target volatile or semi- volatile organic compounds were detected. However, VPH and EPH hydrocarbons fractions were detected. Only total C9 to C22 aromatics at a concentration of 340 µg/l was detected at a concentration exceeding its ground water standard of 210 µg/l. No compound concentrations exceeded gross contamination levels (GCLs) or l 0 times the ground water standard Recommendations Based on the data collected, the site qualifies as a low risk commercial/industrial classification. No ground water remediation is required at low risk sites and soil compound concentrations do not exceed commercial/industrial MSCCs. Please note that the TERRAINE report indicates that the closure samples were collected at 11 ft but the final excavation depth was 12 ft. Therefore, it is unclear if additional soils were removed after the c losure samples were collected. Samples T-1 and T-2 were analyzed for total petroleum hydrocarbons -gasoline range organics (TPH-GRO) and total petroleum hydrocarbons -diesel range organics (TPH-DRO). Analytical results of soil sample T-1 indicated 270 mg/kg TPH-GRO and 4,100 mg/kg TPH-DRO. Results of the analysis of soil sample T-2 indicated TPH-GRO at 13 mg/kg and TPH-DRO at 1,200 mg/kg. An LSA Risk Classification and Land Use Form is provided in Appendix A. A discussion of potential receptors and land use is provided below. 3.1 Receptor Information 3.1.1 Water Supply Wells Municipal water is provided to the site and available to areas within 1,500 ft of the site. H&ll conducted a water supply well survey for the area within a 1,500 ft radius of the former UST basin (Figure 1 ). The survey was conducted by performing an area reconnaissance of the properties within the specified radius. No water supply wells were identified within the 1,500 ft radius of the former UST basin. Based upon H&Ws knowledge of the site area, the urban setting, and the area reconnaissance, a more detailed survey was not warranted. 3.1.2 Surface Water The closest surface water body to the former UST area is an unnamed intermittent stream located approximately 800 ft southeast of the former UST basin (Figure 1 ). Additionally, a small pond is located approximately 1,000 ft west of the site. No other surface water bodies were noted. 3.1.3 Subsurface Structures Visual observations were made for potential subsurface conduits in the vicinity of the fonner UST. No indications of subgrade utilities were observed or located by a utility locating service in the vicinity of the former UST basin. The closest subgrade utilities observed by H&H were located parallel to and approximately 5 ft west of South Boulevard. These utilities are located approximately 100 southeast of the former UST basin. Due to the distance from the former UST basin, these identified subgrade utilities are not expected to be a conduit for contaminant migration. 1 \ul.mutcr pn>jt<Ulhanh tire colh1c.o l't>h I llllrcpon -6 Hart & Hickman, PC I I I I I I I I I I I ·I I I I I .1 I I 4.0 Geology and Hydrogeology 4.1 Regional Geology and Hydrogeology The subject property is located in the Piedmont Physiographic Province of North Carolina. According to the Geologic Map of North Carolina dated 1985, the subject property lies with the Charlotte Belt of the Piedmont. In the site area, underlying bedrock is composed of metamorphosed quartz diorite. The land surface of the area is generally characterized as gently sloping, which may become moderately steep where intersected by streams. In the Piedmont, the bedrock is overlain by a mantle of weathered rock tenned saprolite or residuum. The saprolite consists of unconsolidated clay, silt, and sand with lesser amounts of rock fragments. Due to the range of parent rock types and their variable susceptibility to weathering, the saprolite ranges widely in color, texture, and thickness. Generally, the saprolite is thickest near interstream divides and thins toward streambeds. ln profile, the saprolite nonnally grades from clayey soils near the land surface to highly weathered rock above the competent bedrock. The occurrence and movement of ground water in the Piedmont is typically within two separate but interconnected water-bearing zones. A shallow water-bearing zone occurs within the saprolite and a deeper water-bearing zone within the underlying bedrock. Ground water in the shallow saprolitc zone occurs in the interstitial pore spaces between the grains comprising the saprolite soils. Ground water in this zone is typically under water table or unconfined conditions. Ground water movement is generally lateral from recharge areas to small streams that serve as localized discharge points. The occurrence and movement of ground water in the underlying water-bearing zone within the crystalline bedrock is controlled by secondary joints, fractures, faults, and dikes within the bedrock. On a regional scale, the direction of ground water flow is typically from uplands to major streams and ground water sinks. Juliet, Tennessee. Chain-of-custody record and laboratory analytical data sheets are provided in Appendix C. 5.1 Soil Sampling Results Table 1 sumrnanzes the soil analytical resul ts. Target compounds were detected at low concentrations in sample MW-1 (11.S -13.S ft) which included EPH and VPH hydrocarbon fractions as well as petroleum related VOCs and SVOCs. Of the compounds detected, VPH CS to C8 aliphatics, total C9 lo C22 aromatics, and naphthalene were present above NCDENR soil to ground water Maximum Soil Contaminant Concentrations (MSCCs). VPH CS to C8 aliphatics were detected at a concentration of 92 mg/kg, total C9 to C22 aromatics were detected at 810 mg/kg, and naphthalene was detected at 0.61 mg/kg (as a VOC and at 2.0 mg/kg as a SVOC), compared to their respective soil to ground water MSCCs of 72, 34 and O.S8 mg/kg. Of these compounds, only total C9 to C22 aromatics exceeded the residential direct contact MSCC of 469 mg/kg. No compounds exceeded their respective industriaJ/commercial direct contact MSCCs. 5.2 G round Water Sampling Results Table 2 summarizes the ground water sampling results. No target volatiles or semi-volatile organic compounds were detected. However, the laboratory analysis indicated the presence of VPH and EPH hydrocarbon fractions. In addition, five petroleum related tentatively identified compounds (TI Cs) were detected at low concentrations(< IS µg/l). Of the compounds detected, only total C9 to C22 aromatics at 340 µg/l was detected at a concentration exceeding its North Carolina ground water standard of 210 µg/l. All associated method analytes will be subject to an elevated detection limit relative to the dilution factor. The reported value failed to meet the established quality control criteria for a ccuracy. RIN(EPA)-Re-Analyzed: The indicated analytical results were generated from a reinjection of the same sample extract or aliquot. Surrogate recovery limits have been exceeded; values are outside lower control limits Qualifier Report Information ESC recognizes and utilizes sample and result qualifiers as set forth by the EPA Contract Laboratory Program. We firmly believe that information pertaining to sample analysis should be made available to the ESC client. In addition to the EPA qualifiers adopted by ESC, we have implemented ESC qualifiers to provide more information pertaining to our analytical results. Each qualifier is designated in the qualifier explanation as either EPA or ESC. Definitions: Accuracy -The relationship of the observed value of a known sample to the true value of a known sample. Represented by percent recovery and relevant to samples such as: control samples, matrix spike recoveries, surrogate recoveries, etc. Precision -The agreement between a set of samples or between duplicate samples. Relates to how close together the results are and is represented by Relative Percent Differrence. Surrogate -Organic compounds that are similar in chemical composition, extraction, and chromotography to analytes of interest. The surrogates are used to determine the probable response of the group of analytes that are chem- ically related to the surrogate compound. Surrogates are added to the sample and carried through all stages of preparation and analyses. TIC -Tentatively Identified Compound: Compounds detected in samples that are not target compounds, internal standards, system monitoring compounds, or surrogates. (HES) is submitting this correspondence documenting our observations and findings during recent environmental assessment activities at the above referenced site. Background Information The subject site is located at 2500 South Boulevard, in Charlotte, Mecklenburg County, North Carolina. The subject property is located in an area of predominantly residential and commercial land uses. South Boulevard is located to the Southeast of the site, with commercial properties located to the North, East and South of the subject property. Railroad tracks are located immediately adjacent to the Northwest of the site, with residential properties located beyond the tracks to the North and West of the subject property. Diagrams depicting the location of the site are included as Figure 1, Figure 2, and Figure 3, included in Attachment A. At the request of Mr. Wade Finger of Pappas Properties, LLC, (Pappas) HES conducted environmental assessment activities at the site to assess for the presence of soil impacted by regulated chemical constituents in and around the area of a former underground storage tank (UST) system previously located at the subject site. This project was undertaken to assess and delineate the extent of petroleum- impacted soil at the site. It was known that other limited environmental assessment projects had been undertaken at the site, and that soil and groundwater impacted by regulated chemical constituents had been detected during these investigations. It was also known that the site received a Notice of No Further Action (NFA) from the NCDENR on December 20, 2001, based on an approved NORP applied to the property deed. This NORP placed two restrictions on the property: 1. The land use of the property was restricted to Industrial/Commercial use only; and, 2. The installation of water supply wells was prohibited on the property for any reason. Based on potential future usage of the property, Pappas retained HES to determine the extent of petroleum-impacted soil remaining on the property. The scope of HES’ investigation was as follows:  Advance a series of soil borings around the former UST cavity and collect continuous soil samples to a maximum depth of 15 feet below grade (it should be noted that based on site grade and findings in the field that the depth for all borings was extended to at least 20 feet and to 25 feet in three borings (located at a higher elevation then the former loading dock area where the UST was previously located); 3117 Lantern Way; Wilmington, NC 28409 Phone: 910-795-8262 / www.HESfast.com Mr. Wade Finger June 4, 2014 Limited Phase II ESA – 2500 South Blvd; Charlotte, NC Page 2  Evaluate soil samples for evidence of petroleum impact (odor, staining, etc.) and field screen for organic vapors using a photoionization detector (PID);  Submit a maximum of eight soil samples to a North Carolina approved laboratory for analysis for gasoline and diesel range organics (GRO and DRO). In addition, two of the soil samples will be selected for expanded analysis of volatile and semi-volatile organic compounds (VOCs and SVOCs), Volatile Petroleum Hydrocarbons (VPH) and Extractable Petroleum Hydrocarbons (EPH); and  Prepare a report summarizing all site activities. Site Assessment and Sampling Activities HES subcontracted with Probe Technology, Inc., (PTI) for environmental drilling services. Personnel and equipment from HES and PTI were on-site on May 19, 2014 for soil sampling activities. During site activities, HES personnel inspected the area of the former UST and was able to locate what appeared to be a groundwater monitoring well that was identified on documentation provided to HES. In addition, and based on the documentation, HES personnel then identified where the former UST cavity was situated on the subject property. HES then used a “step-back” approach by first installing a boring in close proximity to the four sides of the former UST cavity. Initially, one boring was placed on each of the four sides of the former cavity [SB-1 (West), SB-2 (South), SB-3 (East) and SB-4 (North)]. With the exception of the boring located to the West (SB-1), the initial soil borings along the North, South and East of the cavity all indicated that the soils where impacted by petroleum as indicated by odor and field screening (using the PID) measurements. Based on field screening measurements, subsequent borings were placed a reasonable distance beyond the former UST cavity to allow for determining the extent of the petroleum-impacted soil. In all, HES advanced a total of ten soil borings on the subject property. The locations of the soil borings are depicted on Figure 4 (included in Attachment A), as well as in the photolog included in Attachment B. Each soil boring was advanced using a Geoprobe® (i.e. direct-push) drilling rig utilizing five five-foot long MacroCore® soil samplers. The MacroCore® samplers were equipped with acetate sampling sleeves, which were changed between sample intervals. At each soil boring location, continuous soil samples were collected from the ground surface to the boring termination depth. Upon retrieval, the sampling sleeve was opened, and the soil sample was examined for evidence of soil impact (i.e. staining, odor, etc.) by regulated chemical constituents, hydrocarbon staining or obvious odors. A soil sample was then collected along the length of the sampling sleeve, and divided into two aliquots. The first aliquot was placed in a clean, labeled, zip-lock bag that was evacuated of air and maintained on ice pending possible selection for laboratory analysis. The second aliquot was placed in a clean, labeled, zip-lock bag that was sealed and placed in direct sunlight to equilibrate for approximately 10 minutes. At the end of the equilibration period, the headspace in the sample bag was then field screened for the presence of organic vapors using a RAE Systems MiniRAE photoionization detector (PID). To field screen the headspace, the sample probe for the field screening instrument was inserted into the headspace in the bag, and the approximate concentration of organic vapors in the headspace was displayed on the field unit. Based on field observations and screening data, eight soil samples were selected for laboratory analysis. Soil samples submitted for laboratory analysis were containerized in labeled, laboratory supplied containers, maintained on ice, and delivered, using proper chain of custody procedures, to a North Carolina-certified analytical laboratory (SGS North America, Inc.) for laboratory analysis of parameters as follows:  Eight soil samples (SB-1 [15’20’], SB2-2 [15-20’], SB-2-3 [20’-25’], SB-3-2 [10’-15’], SB-4-2 [10’- 15’] and SB-4-4 [15’-20’] were analyzed for GRO and DRO, by Method 8015;  Two soil samples (SB-2-3 [20’-25’] and SB-4-2 [10’-15’]) were analyzed for VOCs, by Method 8260; SVOCs, by Method 8270C; and VPH and EPH, by the MADEP Method. Laboratory analytical data for soil samples collected at the site are summarized on Table 1 included in Attachment C. A copy of the laboratory data report is included in Attachment D. Laboratory analysis of these samples resulted in:  The detection of GRO above the state UST action level of 10 mg/Kg in soil borings SB-2 (15’-20’), SB-2-2 (15’-20’), SB-3 (15’-20’)and SB-4-2 (10’-15’);  The detection of DRO above the state UST action level of 10 mg/Kg in soil borings SB-2 (15’-20’), SB-2-2 (15’-20’), SB-3 (15’-20’)and SB-4-2 (10’-15’) and SB4-4 (15’-20’);  Numerous volatile organic compounds (VOCs) were detected in soil sample SB-4-2 (10’-15’) (sample yielding the highest DRO concentration) with only acetone and naphthalene being detected in soil sample SB-2-3 (20’-25’). The reported concentrations in both samples were very low, and no reported concentrations exceeded their NCDENR Residential Maximum Soil Contaminant Concentrations (MSCC), as revised 4/16/2012;  Several SVOC compounds (including: acenaphthene, 2-methylnaphthalene, naphthalene; and phenanthrene) were detected in soil sample SB-4-2 (10’-15’); however, no reported concentrations exceeded their respective NCDENR Residential MSCCs. No detectable concentrations for SVOC compounds were reported for sample SB-2-3 (20’-25’); and  Several hydrocarbon fraction ranges for VPHs and EPHs were reported for both samples SB-2-3 (20’-25’) and SB-4-2 (10’-15’) with all but two fractions (C9-C18 Aliphatics and C9-C22 Aromatics) for SB-4-2 (10’-15’) less than their respective NCDENR Residential MSCCs. The C9-C18 Aliphatics and C9-C22 Aromatics concentrations for SB-4-2 (10’-15’) were reported at 1520.8 mg/Kg and 644.7 mg/Kg respectively (above their NCDENR Residential MSCCs of 1500 mg/Kg and 469 mg/Kg). In summary, two regulated chemical constituents (fraction C9-C18 Aliphatics and C9-C22 Aromatics) were detected above their respective NCDENR Residential MSCCs for soil sample SB-4-2 (boring location situated downgradient from the former area of the UST cavity).
