Robertson, property owner. Property transferred to David Shelton November, 2015. A new Land Clearing and Inert Debris Landfill Notification must be recorded with the Forsyth County Register of Deeds by David Shelton prior to the resumption of landfill operations. PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Photos included in this report were taken by Susan Heim, Solid Waste Section, on July 6, 2016. 2. The facility is a Land Clearing and Inert Debris Landfill Notification site which is permitted to accept only land clearing waste, inert debris, untreated wood and yard trash. 3. The property is currently owned and operated by David Shelton. Mr. Shelton purchased the property in November of 2015. Brian Shelton, son of the property owner David Shelton, was present at the inspection representing the property owner. 4. A Land Clearing and Inert Debris Landfill Notification was recorded with the Forsyth County Register of Deeds on August 25, 2008 by Jean H. Robertson, the property owner. 5. The notified LCID landfill has not been operational in more than 5 years, due to the illness and death of the previous owner/operator. 6. Ensure that a Land Clearing and Inert Debris Landfill Notification is recorded with the Forsyth County Register of Deeds by David Shelton, property owner, prior to resuming landfill operations, as required by 15A NCAC 13B .0563(2)(a). 7. A Yard Waste Notification site is also located on the property (YWN-34-016), and is operated by Paul Shropshire. 8. Open burning of land clearing waste is prohibited at the site. 9. The property is bounded by dense woodland. 10. Access to the facility is restricted by means of a gate. Ensure that the gate remains secured to prevent unauthorized access when an operator is not on duty at the site, as required by 15A NCAC 13B .0566(8). 11. Ensure that a sign is posted at the facility entrance showing the contact name and number and the permit number, as required by 15A NCAC 13B .0566(16). 12. The site is clean and well-maintained; no storm water runoff or erosion issues were observed. The property owner has been working with Forsyth County on effective erosion control and to restore the sediment pond and drainage channels at the site. 13. Access roads are of all-weather construction and in good condition. 14. Ensure permanent edge of waste markers that accurately designate the waste disposal boundary are installed and maintained at the facility. 15. Ensure that solid waste is restricted to the smallest area feasible and compacted as densely as practical into cells. 16. In order to be in compliance with state regulations, adequate soil cover must be applied to the waste at least monthly, as specified in 15A NCAC 13B .0566(4). Ensure that adequate soil cover is applied to all exposed waste in the landfill. 17. Ensure that the site is policed throughout the operating day and that prohibited materials, including trash, tires, plastics, etc. are segregated and stored, if necessary, under cover prior to removal to a permitted disposal facility. 18. Ensure that adequate buffers are maintained, as required by 15A NCAC 13B .0564(9)(a) and 15A NCAC 13B .0564(9)(b). Gated entrance to facility. Restored sediment basin.
