Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. ADDITIONAL COMMENTS 1. The submitted land application records did not show which field the septage was discharged on. Septage Management Rule .0838(e)(1) states “Permit holders of septage land application sites shall develop and maintain records and reports to demonstrate compliance with this Section and the permit requirements of each site. (1) Permit holders of sites receiving septage shall maintain a log which meets the requirements of 40 CFR Part 503.17(b).” The discharge events need to be recorded on a field basis to satisfy the requirements of 40 CFR Part 503.17(b). Based on work done by the Division, Field 1 has approximately 6.8 acres and Field 2 has approximately 5.3 acres. These acres will be listed in the permit. Upon review of the submitted nutrient management plan, it was observed that several months within the Relative Application Rate Table in Section D had an application rate of “None” listed. See below. Months that have “None” listed mean that 0 gal/ac could be applied to the particular field during that month. Therefore, no septage should be discharged on a field that has “None” listed. It is recommended that you have your nutrient management plan revised to replace the “None” application rates with an appropriate rate for the crop. Along with the Relative Application Table, the Field acres and crop nitrogen rates need to be revised. These revisions to the nutrient management plans will need to be done by a Technical Specialist. Upon receiving the renewed permit for SLAS-27-08, you will need to follow the permit and the submitted nutrient management plan until a revised nutrient management plan has been submitted and permit SLAS-27-08 has been modified to reflect the changes.
