Prior to the compliance deadline Evergreen Packaging, Inc. and Ridge Paper Products, Inc. repaired the rill erosion, replaced the 18 inches of cover soil as specified in the “Operations & Maintenance Manual Landfill No. 6, section 2.9.3.2 Site Security and Maintenance.” Evergreen Packaging, Inc. and Blue Ridge Paper Products, Inc. also seeded and mulched the Asbestos Containing Material (ACM) with the intent to establish a groundcover sufficient to restrain erosion. On June 16, 2016 the facility submitted photographs to the section of the Asbestos Containing Material (ACM) Area showing immediate action to repair and restore the cover issues observed during the June 15, 2016 inspection. The facilities prompt attention and remediation to the cover issues is appreciated. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 OBSERVED VIOLATIONS: None ADDITIONAL COMMENTS 1. All photos were taken by Lee Hill on July 12, 2016. 2. On July 8, 2016 the section received a response to the Notice of Violation dated June 28, 2016. 3. This inspection was to resolve the erosion and cover violations observed during the June 15, 2016 inspection of Landfill No 6. 4. Facility staff sent pictures of repairs to the cover soil in the Asbestos Containing Material (ACM) area on June 16, 2016. Operations Inspection of Asbestos Containing Material (ACM) Area 5. The four locations where exposed asbestos waste bags were observed during the June 15, 2016 inspection had been repaired. 6. The facility has added soil to locations in the ACM area to ensure that all waste has a minimum of 18 inches of cover soil. 7. The facility has created and instituted a new asbestos cell inspection program. This program includes a written log that is kept at the leachate pump house. The facility inspects the ACM area at a minimum of once per week and after every rainfall that is greater than 0.5 inch. 8. Facility staff stated that the ACM area was seeded and mulched on June 16, 2016 9. On July 8, 2016 the facility was not satisfied with the establishment of groundcover and hydroseeded the ACM area. 10. The major rill erosion that was observed during the June 15, 2016 inspection had been repaired. 11. The facility has stockpiled soil and wood mulch at the ACM area for use in repairing any issues to the cover soil that may occur in the future. 12. Adding a soil diversion berm to prevent concentrated water flow on the slopes was discussed onsite. 13. Groundcover establishment in the Asbestos Containing Material (ACM) area will be evaluated in subsequent inspections of the facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
