Trade St Tryon, NC 28782 PARTICIPANTS: Lee Hill, NCDEQ – Solid Waste Section Joey Davis, Town of Tryon (via phone 07/08/2016) STATUS OF PERMIT: Expired May 31, 2016 PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: N/A OBSERVED VIOLATIONS: 15A NCAC 13B .1406(g)(3)(A) Notification of the Solid Waste Section prior to operation and on an annual basis as to: (i) Facility location; (ii) Name, address and phone number of owner and operator; (iii) Type and amount of wastes received; (iv) Composting process to be used; and (v) Intended distribution of the finished product. The Town of Tryon is in violation of 15A NCAC 13B .1406(g)(3)(A) in that it failed to renew the Yard Waste Notification that expired on May 31, 2016 and continued to store and process material onsite. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 Within fifteen (15) days the Town of Tryon must submit a new Yard Waste Notification or a closure form and plan for the removal and disposal of all on-site material. 15A NCAC 13B .1406(6) A site shall only accept those solid wastes that it is permitted to receive. The Town of Tryon is in violation of 15A NCAC 13B .1406(6) in that numerous plastic bags containing leaves were observed in the operations area during the July 7, 2016 inspection. Some of the bagged leaves also contained MSW. Within fifteen (15) days the Town of Tryon must remove all plastic bags and MSW from the Yard Waste area and dispose of the material in the proper location. Plastic Bagged leaves with MSW. ADDITIONAL COMMENTS  All photos were taken by Lee Hill on July 7, 2016  A records review conducted on July 7, 2016 revealed that the facility failed submit a Yard Waste Notification Facility Renewal Form. Please see observed violation section of this report.  The Yard Waste Notification Facility Renewal Form can be found at http://deq.nc.gov/about/divisions/waste- management/waste-management-permit-guidance/solid-waste-section/yard-waste. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. Some of the bagged leaves contained MSW. All plastic bags and MSW must be removed and disposed of in the proper location. Please see observed violations section of this report.  The road was constructed of gravel and was in good condition at the time of inspection.  Adequate access was provided for firefighting equipment.  It appeared that less than 6000 yds3 of material was on site at the time of inspection.
