The City of Hendersonville is in violation of 15A NCAC 13B .1406 (3) by failing to divert storm water from the material storage area. Ponding water was observed in the unground material storage area. Within 30 days the City of Hendersonville must divert surface water and grade the area to ensure positive drainage so that water will not be impounded. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 Impounded Water in the Land Clearing Debris Stockpile Area ADDITIONAL COMMENTS  The facility is secured by gates and chain link fence.  The facility collects yard trash and land clearing debris at the facility.  The access roads around the facility were gravel and were in good condition.  Leaves are collected in a separate area from the land clearing debris and other yard trash.  Water was observed impounded in the land clearing debris stockpile. Please see observed violations section of this report.  A minimal amount of unapproved material (plastic garbage bag, artificial flowers) were observed in the leaf collection area. Please remove unapproved material and dispose of the material in the proper location.  The 2016-2017 notification form stated that that the facility had >6000 cubic yards on site. However, at the time of inspection it appeared that less than 6000 cubic yards of finished and unfinished material was on site.  A small amount of leachate was observed in the leaf collection area. It did not appear that leachate had left the property at the time of inspection. Per 15A NCAC 13B .1406 (4) “Leachate shall be contained on site treated to meet the standards of the off-site disposal method.”  Records including temperature data is kept at the Public Works Building located at 305 Williams Ave, Hendersonville and was available upon request. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
