STATUS OF PERMIT:
Coal Combustion Products Structural Fill constructed per 15A NCAC 13B .1700 Solid Waste Rules
PURPOSE OF SITE VISIT:
Comprehensive inspection to ensure that the Structural Fill Facility is in compliance with 15A North Carolina
Administration Code (NCAC) 13B. 1700, “Requirements For Beneficial Use Of Coal Combustion By-Products.”
STATUS OF PAST NOTED VIOLATIONS:
15A NCAC 13B .1705 (a) The structural fill facility must be designed, constructed, operated, closed, and
maintained in such a manner as to minimize the potential for harmful release of constituents of coal
combustion by-products to the environment or create a nuisance to the public. RESOLVED
15A NCAC 13B .1705 (e) The coal combustion by-product structural fill facility shall be effectively
maintained and operated as a non-discharge system to prevent discharge to surface water resulting from
the operation of the facility. RESOLVED
15A NCAC 13B .1705 (j) All structural fills shall be covered with a minimum of 12 inches compacted earth,
and an additional surface six inches of soil capable of supporting native plant growth. RESOLVED

15A NCAC 13B .1706 (b) The final surface of the structural fill shall be graded and provided with drainage
systems that: (1) Minimize erosion of cover materials; and (2) Promote drainage of area precipitation,
minimize infiltration and prevent ponding of surface water on the structural fill
Standing water was observed on the structural fill at the time of the inspection. UNRESOLVED
15A NCAC 13B .1706 (c) Other erosion control measures, such as temporary mulching, seeding, or silt
barriers shall be installed to ensure no visible coal combustion by-product migration to adjacent properties
until the beneficial end use of the project is realized. RESOLVED
OBSERVED VIOLATIONS:
None.
ADDITIONAL COMMENTS
1. 15A NCAC 13B .1705 (j) states All structural fills shall be covered with a minimum of 12 inches compacted
earth, and an additional surface six inches of soil capable of supporting native plant growth. Additional soil
appears to have been brought to the site. Some vegetative growth was visible at the time of the inspection
but additional seeding will be necessary to establish a vegetative cover capable of preventing erosion.

The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

2. There was no exposed coal ash observed.
3. Piles of soil had been dumped on the site. Many of the piles contained miscellaneous waste including tires,
bottles and other trash. It is strongly recommended that gates, berms, chains, etc. be put at entrances to
prevent illegal dumping or Mr. Long is going to have to remove waste on a more frequent basis.
