STATUS OF PAST NOTED VIOLATIONS:
A Notice of Deficiency was issued on April 13, 2015 for violations to Rules .0832(d)(2) and .0839(a). A violation to
Rule .0832(d)(2) was noted for septage being discharged into the septic tank at vacant lot #1108 in the trailer park.
The violation to Rule .0839(a) was noted for failure to record two pumping events in February on the 2015 truck logs. On April 23, 2015 a fax was received that contained a receipt from the City of Rocky Mount Wastewater Treatment
Plant were 2,000 gallons of septage was discharged at the plant on April 21, 2015. On May 12, 2013, pictures
showing the septic tank at vacant lot #1108 being pumped out and a written letter outlining what happened and how the violation will be handled in the future were received.
OBSERVED VIOLATIONS:
NONE
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Follow-up inspection conducted with Mr. Ellis Rodgers to confirm that the septic tank at vacant lot #1108 had
been pumped out. It appeared that the tank had been pumped out (see pictures below). Some water had flowed back in the tank since it was pumped out on April 21, 2015.
2. On May 12, 2013, I received pictures from Mr. Rodgers showing the septic tank at vacant lot #1108 being pumped out. Also, Mr. Rodgers included a written letter outlining what happened and how the violation will
be handled in the future.
