The discharge of septage from one septic tank into another septic tank without the appropriate approval is a violation of Rule .0832(d)(2) that states “Septage, or any part of septage, shall not be reintroduced into an onsite wastewater system unless approved pursuant to G.S. 130A-343(c).” 2) Upon the review of the submitted truck logs for 2015, there were no pumping events listed for February. The failure to list the two admitted pumping events for February is a violation of Rule .0839(a) that states “Each permit holder shall maintain a log which includes at least the following information for each septage pumping event: (1) The date, type, quantity, and location of septage pumped; (2) Location of the discharge of the septage.” The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. On Friday, March 27, 2015, I received a call from Mr. Michael Sipe with the Edgecombe County Health Department concerning a complaint at Midlakes trailer park. Mr. Sipe said that the complaint involved the pumping of waste from septic tanks at the park and then discharging the waste into either a septic tank at a vacant lot or in the woods by the mobile home park. Mr. Sipe also said that he did not receive any information as to the complainant or any description as to where the waste was discharged into the woods. 2. I met with Mr. Ellis Rodgers and Mr. Bruce Taylor on Monday, March 30, 2015, concerning the complaint. Mr. Rodgers told me that he did on two occasions in February pump the waste from a septic tank in the trailer park and discharged the waste into the septic tank at vacant lot #1108 (371 Nicarry Lane). Mr. Rodgers also said that the waste pumped from the septic tanks is never discharged into the woods by the trailer park. Mr. Rodgers said that at the time of the discharge of waste into the septic tank at the vacant lot, he did not have a valid driver’s license and Mr. Taylor was recovering from surgery. Mr. Rodgers also said that he wanted to keep the tank on the pump truck empty in case he needed to pump out another septic tank. Mr. Rodgers showed me the vacant lot where he discharged the waste into the septic tank. See pictures below of the septic tank location. I did not observe any evidence of waste (septage) on the ground by the septic tank. I also did some spot checks in the woods by the trailer park and did not see any evidence that septage had been discharged into the woods. I requested a copy of the truck logs for this year from Mr. Rodgers. Mr. Rodgers said that he would mail them to me. The septic tank for the vacant lot will need to be pumped out and the waste disposed of properly. 3. Any waste, liquid or solid, pumped from a septic tank is considered septage. 4. On April 2, 2015, I received a copy of the truck logs for this year (2015). The truck logs did not list any pumping events for February. All pumping events need to be recorded as required by Rule .0839(a). 5. Midlakes does have a Wastewater Treatment Facility Authorization for the disposal of domestic septage at the Tar River Wastewater Treatment Facility valid through December 31, 2015. 6. I inspected the lettering on the passenger side of the pump truck. The inspection report dated 9-19-14 noted that a few letters on the passenger side of the truck were very worn and should be touched up. The letters had been replaced (see picture below) and are clearly visible. Letters 3 inches in height. Thank you. Vacant lot where Mr. Rodgers said that the waste was discharged into the septic tank.
