Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. A “No Trespassing” sign had been placed at along the access path before you get to the tank. 2. Tank is accessible for inspection. There was an area greater than 5 ft. around the tank that is maintained and free of any debris. 3. Tank appears to be structurally sound. Tank was moved from the site previously permitted as SDTF-40-03. Tank has a storage capacity of 4,000 gallons. 4. Tank has not been permitted yet. No septage transfers have occurred. 5. No odor or vector issues noted. 6. All setbacks distances were checked. Tank location met all setback distances without any issues. Distances to be listed on permit map. 7. Tank has not been used at current location. 8. Should be able to permit tank. Tank cannot be used for septage until permit has been issued. Picture of location and tank. Picture of location and tank.
