STATUS OF PAST NOTED VIOLATIONS:
No violations noted on the inspection conducted on 11/20/13.
OBSERVED VIOLATIONS:
1. Septage was being applied to the field when I arrived. There was significant ponding of septage after the application was completed (see picture on next page). The ponding of liquid after an application of
septage is a violation of Rule .0838(a)(7) that states “Septage shall be applied to the surface of the land
from a moving vehicle in such a manner as to have no standing liquid or soil disturbance resulting from the waste flow after the discharge is complete.” The application method needs to be modified such that
there is no ponding of liquid after the discharge is complete. You may need to increase the speed and spread of the application in order to eliminate the issue with ponding of septage.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may be
subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

ADDITIONAL COMMENTS
1. Required signage present before you get to the site.
2. Access road was in good shape. 3. Markers present.
4. No septage discharges noticed outside of the permitted boundaries.
5. I noticed septage ponded in the field when I arrived. Septage had just been applied to the site.

6. Very poor coverage of the rye.
7. No change noticed with any of the setbacks. 8. I met with Roy concerning issues with the application.
