OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0201(b) states: No person shall cause, suffer, allow, or permit the treatment, storage, or
processing of solid waste upon any real or personal property owned, operated, leased, or in any way controlled by
that person without first obtaining a permit for a solid waste management facility from the Division authorizing
such activity, except as provided in G.S. 130A-294(b).
You were in violation of 15A NCAC 13B .0201(b) in that on June 13, 2016, a septage detention facility (tank)
was established by Carter Septic Tank Service without a permit issued by the Division.
2. 15A NCAC 13B .0836 (h) states: “Operation of a new septage detention or a new septage treatment facility shall
not commence until the facility has been inspected by the Division and found to be consistent with the permit
application.”
You were in violation of 15A NCAC 13B .0836 (h) on June 13, 2016 because a permit application had not been
submitted to the Division.

ADDITIONAL COMMENTS
Directions: Traveling north on Highway 19-23 (future I-26) from Asheville take exit 15 (Jupiter/Barnardsville) and
turn left onto Jupiter Road. Take the first left (after crossing future I-26) onto Old Mars Hill Highway. Travel
approximately ¼ mile and turn right onto the first dirt road past Southwood Drive. The site will be at the end of the
road.

2. On Friday, June 10, 2016, the North Carolina Solid Waste Section-Asheville Regional Office received a
complaint via telephone concerning the possible dumping and/or storage of septage waste at 406 Old Mars Hill
Highway. Complainant stated this property is owned by the father of the owner of Carter Septic Tank Service.
Complainant said several trucks go to the site and he can hear pumps running.
3. On Monday, June 13, 2016, Mr. Troy Harrison and Mr. Lee Hill of the North Carolina Solid Waste Section
went to the site to conduct an investigation. Mr. Brian Carter, Owner of Carter Septic Tank Service was on site
during the investigation. There were three above ground steel tanks on site and Mr. Carter admitted that he was
using one of the tanks (9,000 gallons) as a septage detention or treatment facility (SDTF). The property (PIN #
9744-77-4824-00000) is owned by Leonard & Linda Carter. A permit for the placement or operation of a
septage detention & treatment facility (SDTF) tank had not been issued.

4. Septage was observed on the ground around the 9,000 gallon tank which is located in between the two other
tanks. No evidence of leakage from the tanks were observed.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
