RESOLVED: 15A NCAC 13B .0203(d), cited for failure to capture and properly treat all leachate before its release to the environment. A silicone sealant had been applied to the new concrete curb section since the last inspection on 04/28/2016. Testing the new section of curbing with a hose revealed no leaking or loss of leachate from the collection system. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 2 OBSERVED VIOLATIONS: No new violations were observed during this inspection. ADDITIONAL COMMENTS 1. The facility serves as the MSW transfer station and also as the HHW collection facility for the City of Eden. 2. The facility is permitted to receive only municipal solid waste generated within the City of Eden. Ensure that all waste accepted at the facility is generated within the City of Eden. Proposed changes to the service area must be approved by the Solid Waste Section 3. A partial inspection of the facility was performed, including the building which houses the tipping area/hopper, the leachate collection system, the recycling collection areas and the HHW collection area. 4. The leachate collection system in the tipping area is designed to direct all leachate into a holding tank which drains directly into the public sewer line. The holding tank is pumped out to remove solids as needed. Repairs to the broken curbing designed to direct leachate to the holding tank have resolved the issue of uncaptured leachate at the facility. See comments under CORRECTIVE ACTION above. 5. The HHW collection area was inspected again and found to be clean and well maintained. Paints received at the facility are being emptied into 55 gallon storage drums as they are received. Procedures are now in place requiring an attendant to assist residents with dropping off HHW, to ensure prompt and proper handling of the materials collected. 6. Continue to ensure that all oil-based and water-based paints collected and processed at the facility are removed from the facility at least every six months, or when 400 gallons of either type of material is accumulated, whichever occurs first, as required by the Operations Plan, (DIN 24245). 7. Mr. Dishmon stated that new signs are being ordered for the facility to provide direction to customers and to present a cleaner appearance. 8. The entire site was observed to be clean and well maintained, with materials properly sorted and stored in designated areas. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
