PURPOSE OF SITE VISIT:
Partial Inspection
STATUS OF PAST NOTED VIOLATIONS:
1. CORRECTIVE MEASURES IN PROGRESS: 15A NCAC 13B .0203(d), cited for failure to capture and
properly treat all leachate before its release to the environment. The temporary asphalt patch to the curbing that
directs the leachate to the hopper inside the transfer station building, observed on 3/31/16, had been replaced by
a new concrete curb section. Mr. Dishmon stated that a silicone sealant will be applied in order to eliminate the
small amount of seepage that is still occurring in the area. A follow-up inspection will be made on or around

June 1, 2016 to ensure that the sealant has been applied and the leak has been eliminated. See the comment
section of this report for additional information.
2. RESOLVED: 15A NCAC 13B .0402(7), cited for failure to pick up windblown litter at the facility daily. There
was no windblown litter observed during this inspection. Facility staff have instituted an effective daily clean-
up protocol which is sufficient to resolve this violation, observed previously on March 9, 2016 and March 31,
2016.
OBSERVED VIOLATIONS:
No new violations were observed during this inspection.
ADDITIONAL COMMENTS
1. The facility serves as the MSW transfer station and also as the HHW collection facility for the City of Eden.
2. The facility is permitted to receive only municipal solid waste generated within the City of Eden. Ensure that all
waste accepted at the facility is generated within the City of Eden. Proposed changes to the service area must be
approved by the Solid Waste Section
3. A partial inspection of the facility was performed, including the building which houses the tipping area/hopper,
the leachate collection system, the recycling collection areas and the HHW collection area.
4. The leachate collection system in the tipping area is designed to direct all leachate into a holding tank which
drains directly into the public sewer line. The holding tank is pumped out to remove solids as needed. This part
of the leachate collection system had been compromised by the broken curbing designed to direct leachate to
the holding tank. See comments under CORRECTIVE ACTION above.
5. Oil-based paints are collected at the site, processed and stored in drums within a fully enclosed unit, as
stipulated in the operations plan. All oil-based paints collected since the inspection on March 31, 2016 had been
poured into 55 gallon storage drums stored within the enclosed, locked storage trailer.
6. All water-based paint observed in and around the designated collection area during the March 31, 2016
inspection had been poured into 55 gallon drums stored in the enclosed, locked storage trailer awaiting transport
by Noble Oil Services. The collection area had been cleaned and stacking and holding procedures are being
revised to prevent future problems with storage outside the containment area.
7. Continue to ensure that all oil-based and water-based paints collected and processed at the facility are removed
from the facility at least every six months, or when 400 gallons of either type of material is accumulated,
whichever occurs first, as required by the Operations Plan, (DIN 24245).
8. A review of the facility Permit to Operate and approved Operations Plan was conducted to talk through each of
the provisions with facility staff, to provide technical assistance, and to answer questions relating to operating
procedures and recordkeeping requirements.
9. The Solid Waste Section will conduct a follow-up inspection on or around June 1, 2016 to view the final
repairs to the curbing in the transfer bay which directs leachate to the hopper, and to review records and
documentation including waste screening logs, tonnage reports, HHW transport records, operations plan
and permit to operate.
The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance
with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.
