OBSERVED VIOLATIONS:
1. 15A NCAC 13B .0203(d) states: “by receiving solid waste at a permitted facility, the permittee(s) shall be
considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.”
Permit to Operate No. 79-03T, Attachment 3, Conditions of Permit to Operate, Part VI, #9 states, “All water that

comes in contact with solid waste, including vehicle wash-down water, is leachate and must be captured and
properly treated before release to the environment.”
The City of Eden is in violation of 15A NCAC 13B .0203(d) by failing to capture and properly treat all
water that comes in contact with solid waste (i.e. leachate) before its release to the environment.
The curbing that blocks off the tipping floor from the rest of the structure and directs the leachate to the leachate
collection system is broken, thus allowing leachate to flow across the floor of the adjacent storage area and out of
the building onto the ground.
To achieve compliance, the City of Eden must repair the broken curbing and capture and treat all leachate
before it is released to the environment.

2. 15A NCAC 13B .0402(7) states, “Appropriate method shall be provided to confine material subject to be blown
by the wind within the area. At the conclusion of each day of operation, all windblown material resulting from the
operation shall be collected and returned to the area by the owner or operator.”
The City of Eden is in violation of 15A NCAC 13B .0402(7) by failing to collect all windblown material at
the conclusion of each day of operation.
Windblown trash was observed along all of the fence lines surrounding the facility and in the paved driveway and
parking areas.
To achieve compliance, the City of Eden must collect all windblown material at the conclusion of each day
of operation.

ADDITIONAL COMMENTS
1. The facility serves as the MSW transfer station and also as the HHW collection facility for the City of Eden.
2. Initial transfer operations began at the site in 1984; initial HHW operations began in 1996.
3. Approximately 85-100 tons of MSW is accepted at the facility each week from two City of Eden garbage
collection vehicles that service ~6,000 residences.
4. A partial inspection of the facility was performed, including the building which houses the tipping area/hopper,
the leachate collection system, the recycling collection areas and the HHW collection area.
5. The leachate collection system in the tipping area is designed to direct all leachate into a holding tank which
drains directly into the public sewer line. The holding tank is pumped out to remove solids as needed. This part
of the leachate collection system has been compromised by the broken curbing designed to direct leachate to the
holding tank.
6. Below the hopper, where waste is compacted into transfer trailers at ground level, asphalt berms direct leachate
into a series of drains which also empty directly into the public sewer line. This portion of the leachate
collection system appears to be functioning as designed.
7. Waste is received at the facility from City of Eden trucks that dump directly into the hopper; from the hopper,
waste is compacted into transfer trailers and hauled to the Rockingham County MSWLF for disposal.
8. Each load of waste is screened by the transfer station operator as it is dumped into the hopper, and any banned

with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an
administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit,
or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to
enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any
such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules.

materials are removed for proper disposal before waste is released into the compactor unit.
9. The facility also serves as a drop-off site for residential recyclable materials, including cardboard, paper, glass,
used motor oil and oil filters, used cooking oil, plastic bags, aluminum cans and steel cans, plastic containers
and electronics.
10. Oil-based paints are collected at the site, processed and stored in drums within a fully enclosed unit, as
stipulated in the operations plan.
11. Ensure that the water-based paints collected onsite are stored in containers that are intact, to prevent leaking,
and within the covered containment area.
12. Ensure that all oil-based and water-based paints collected and processed at the facility are removed from the
facility at least every six months, or when 400 gallons of either type of material is accumulated, whichever
occurs first, as required by the Operations Plan, (DIN 24245).
13. Reviewed training certifications for the facility: Rodney Carter, Certified Transfer Station Operations Specialist,
expires 07/15/2018; Elmer Curry, Certified Transfer Station Operations Specialist, expires 04/14/2018.
14. The Solid Waste Section will conduct a follow-up inspection to view the oil-based paint storage unit
(locked and inaccessible during initial inspection on 3-9-2016) and to review records and documentation
including waste screening logs, tonnage reports, HHW transport records, operations plan and permit to
operate.
