Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On June 23, 2016, John Patrone met with Kenneth Phillippie to conduct a comprehensive inspection of the Phillippie LCID Landfill – Kimesville Road on Kimesville Road in Burlington, Alamance County. 1. The Phillippie land clearing and inert debris (LCID) landfill – Kimesville Road is owned and operated by Kenneth Phillippie. 2. The LCID landfill entrance is located off of Kimesville Road, across from Boyd Wright Road. 3. Mr. Phillippie stores machinery and supplies for his grading company and, in the future, may build his residence on the lot. The property is ~ 21 acres in size. 4. Logs are removed from incoming land clearing debris (LCD) and stored separately for firewood. 5. Inert materials (concrete, brick, rock, gravel, uncontaminated soil, and used asphalt) are stored for use on site and by Mr. Phillippie’s grading and hauling company. 6. Storage areas and other operations conducted on the property should be setback from the LCID landfill. It is suggested that a 50 foot buffer area be maintained. 7. Per 15A NCAC 13B .0564(9)(b), “The facility shall meet the following buffer requirements: 100 feet from the disposal area to property lines, residential dwellings, commercial or public buildings, and wells.” 8. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 9. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 10. Side slopes should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed. 11. The SWS received a complaint on June 21, 2016 stating that the complainant was told that a load of demolition debris was observed being hauled into the Phillippie LCID Landfill – Kimesville Road. Mr. Patrone contacted Mr. Phillippie on June 21, 2016 to discuss the complaint. Mr. Phillippie stated that the facility has received a load of material consisting of LCD and inert materials from a DOT project. Mr. Patrone conducted an inspection of the landfill on June 23, 2016 and met with Mr. Phillippie. The load of material in question was left uncovered. No unacceptable material was observed. 12. Open burning of solid waste is prohibited. 13. The facility has an all-weather access road. 14. The site is secured by a metal chain and lock. 15. The facility has a proper sign.
