OBSERVED VIOLATIONS: 1. 15A NCAC 13B .0203(d) states: “by receiving solid waste at a permitted facility, the permittee(s) shall be considered to have accepted the conditions of the permit and shall comply with the conditions of the permit.” Permit to Operate No. 8807, Attachment 3, Conditions of Permit to Operate, Part II, #27 states that “The following, at a minimum, must not be accepted for disposal at the facility: hazardous waste, yard trash, liquid wastes, regulated medical waste, sharps not properly packaged, PCB waste as defined in 40 CFR 761, and wastes banned from disposal in North Carolina by G.S. 130A-309.10(f).” FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 9 15A NCAC 13B .1626(1)(a) states: “A MSWLF shall only accept those solid wastes which it is permitted to receive. The landfill owner or operator shall notify the Division within 24 hours of attempted disposal of any waste the landfill is not permitted to receive, including waste from outside the area the landfill is permitted to serve.” G.S. 130A-309.10(f)(3) states: “Prohibited acts relating to packaging; coded labeling of plastic containers required; disposal of certain solid wastes in landfills or by incineration prohibited.” “Yard trash, except in landfills approved for the disposal of yard trash under rules adopted by the Commission. Yard trash that is source separated from solid waste may be accepted at a solid waste disposal area where the area provides and maintains separate yard trash composting facilities.” Transylvania Counting is in violation of 15A NCAC 13B .0203(d), 15A NCAC 13B .1626(1)(a), and G.S. 130A- 309.10(f)(3) in that yard trash was observed being deposited in the landfill during the June 10, 2016 inspection. To correct the violation Transylvania County must divert all yard trash from the MSWLF Unit to the LCID area of the landfill. Yard Trash on Working Face. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 3 of 9 ADDITIONAL COMMENTS Operational Inspection of MSWLF Unit (8807) June 6, 2016 Inspection 1. All photos were taken by Lee Hill unless otherwise noted. 2. Soil sampling results were sent to Ervin Lane, Compliance Hydrologist on May 13, 2016. 3. The previous working face and slopes on the south side of the landfill were hydro-seeded and mulched on June 4, 2016. 4. A berm has been installed across the top of the landfill to prevent storm water from running down side slopes. 5. Facility staff repaired a leachate seep on the south slope of the landfill approximately two weeks ago. During the repair a small amount of waste was left on the surface. Remove the waste from the slope and deposit it on the working face of the landfill. 6. A leachate seep has occurred at the toe of the southeastern side of the landfill close to the edge of liner. Please repair this seep immediately to ensure leachate or waste does not move off the liner. 7. Rill erosion that has occurred on the southeastern side of the landfill has not been addressed. This erosion has resulted in waste to becoming exposed. Repair rill erosion that is occurring and ensure that all waste is covered. 8. A substantial amount of exposed waste was observed on the southeastern side of the landfill. Cover all exposed waste with soil immediately. 9. The working face is located on the southwest side of the landfill and was smaller than during the April 6, 2016 inspection and appeared that it could be covered adequately with an approved alternative daily cover. 10. It appears that the side slope located adjacent to the working face is steeper than 3:1. All slopes should be no greater than 3:1. 11. All areas of the landfill where additional waste will not be placed on them for 12 months or more, but where final termination of disposal has not occurred, must be covered with a minimum of one foot of intermediate cover. 12. Litter fence as specified in Letter A of the Corrective Action Plan has not been installed. Install the litter fence to help control the windblown litter issues. 13. Slopes drains as specified in Letter B of the Corrective Action Plan have not been installed. Install slope drains to prevent further erosion of the landfill side slopes. 14. A significant amount of windblown litter was observed at the time of inspection. Windblown litter must be picked up at the end of each working day. June 10, 2016 Inspection 15. During the June 10, 2016 inspection, soil berms were installed to contain the waste that was being disposed of that day. The soil berms were constructed of previous soil cover which contained waste. Soil berms constructed of waste containing soil must be covered with 6 inches of clean soil or by an approved alternative cover at the end of the day. All waste must be covered at the end of the working day regardless of its location. 16. The leachate seep on the toe of the southeastern side of the landfill that was observed on June 6, 2016 had been repaired. 17. A large pit had been dug at the site of a leachate outbreak on the west side slope of the landfill. 18. A pickup truck load of branches and yard trash was observed on the working face of the landfill. Yard trash is banned for disposal in MSW landfills. Please see observed violations section of this report. 19. Facility staff was in the process of adding more soil cover to the southeastern side of the landfill at the time of inspection. 20. All bare areas on the landfill slopes need to seeded and mulched to prevent erosion of the landfill side slopes. 21. Significant improvement in windblown litter issues had been made from the June 6, 2016 inspection. 22. A leachate seep was observed on the lower portion of the west slope of the landfill. 23. Facility staff had made efforts to flatten the side slopes of the landfill. Please continue to flatten side slopes to a maximum of 3:1. Facility staff sent pictures on June 10, 2016 at approximately 7:00 PM showing that the upper and lower seeps had been filled in and that the waste laden berm and working face had been covered with a tarp. Inspection of Groundwater Monitoring Wells. 25. Monitoring wells were observed during the June 6, 2016 inspection. 26. MW-1 was locked and the concrete pad needs cleaning. 27. MW-2 was locked. 28. MW-3 was locked and needs sediment cleaned from the concrete pad. 29. MW-5 was locked. 30. MW-6 was locked and needs vegetation cleaned from around the pad. 31. MW-8 was locked and need material removed from the concrete pad. 32. MW-9SR was locked. 33. MW-9D had a lock attached however it appears that the lock does not secure the top of the cap to the well. Please repair the locking mechanism so that is functions as intended. 34. MW-10 was locked 35. MW-11 was locked and sediment has accumulated up approximately 2/3 of well housing. Please clean sediment from around well. 36. MW12-S was locked. 37. MW12-D was locked but the placard was unattached. Please reattach the placard to the well. 38. MW-13 was locked.
