Roger Maness, Manager - Key Properties LCID Landfill and Processing Facility Priscilla Maness, Office Manager - Key Properties LCID Landfill and Processing Facility STATUS OF PERMIT: Permit To Operate (PTO) issued April 24, 2014 PTO expiration date April 24, 2019 PURPOSE OF SITE VISIT: Comprehensive Inspection STATUS OF PAST NOTED VIOLATIONS: None FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 4 OBSERVED VIOLATIONS: None ADDITIONAL COMMENTS On June 15, 2016, John Patrone met with Bobby King, Phil Martin, Roger Maness, and Priscilla Maness to conduct a comprehensive inspection of the Key Properties LCID Landfill and Processing Facility on Sandy Cross Road in Burlington, Alamance County. 1. The facility is a land clearing and inert debris (LCID) landfill. The permitted LCID landfill consists of a North Cell and a South Cell and incorporates an existing notified LCID landfill (N0705). 2. The facility permit includes a yard waste grinding operation that is conducted atop a notified LCID landfill (N0475). The notified LCID landfill is covered with soil and is no longer active. 3. The facility permit – the landfill and yard waste grinding operation - encompass two parcels of land. The active landfill is on parcel No. 170356 – Lot # 1, Bk 2035 Pg 209 and the yard waste grinding operation is on parcel No. 155212 – Lot # 2, Bk 2035 Pg 209. 4. The facility has a temporary disaster debris staging site (TDDSS) associate with both parcels of land. The TDDSS number is DS01-012. 5. Ensure Attachment 2 – Conditions of Permit to Construct are met prior to the operation of the landfill cells. 6. The facility has not constructed the North and South Cells to date although the North Cell has been cleared of trees. 7. The facility has constructed an additional area [1.20 acres] that abuts the existing notified LCID landfill that has been incorporated into the facility permit. 8. The facility is placing LCID in the 1.20 acre area. The existing notified LCID landfill area contains soil cover. Soil is being stored atop the LCID landfill area for future use. 9. The facility has submitted the permit application for the 1.20 acre area that was constructed. The facility is permitted to receive LCID generated within: Alamance, Caswell, Chatham, Durham Forsyth, Guilford, Orange, Person, Randolph, Rockingham, and Wake Counties. 11. The facility is permitted to receive land clearing waste, yard trash, untreated and unpainted wood, uncontaminated soil, inert debris, and (used) asphalt. 12. Solid waste must be covered with 1 foot of suitable soil cover at least once per month, or when the active area reaches one acre in size, whichever occurs first. The side slopes must also be covered with soil accordingly. 13. Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells. 14. Excavation, grading, and fill material side slopes must not exceed a ratio of three horizontal feet to one vertical feet (3:1). 15. A ready supply of soil shall be available for cover material. 16. Records were reviewed for the amount of yard waste received for processing. To date, the facility has 2,025 yd3 on site: 986 yd3 unprocessed and 1,039 yd3 of mulch. 17. The LCID landfill annual report (FAR) was received by the SWS on June 30, 2015. Estimated facility throughput for July 2014 through June 2015 is 14,300 yd3. 18. The yard waste grinding operation FAR was received by the SWS on July 24, 2015. Facility throughput for July 2014 through June 2015 is 16,906 yd3 with 904 yd3 on site. 19. The facility shall not grind high nitrogen:carbon ratio material. The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. The Pleasant Grove Volunteer Fire Department, Faucette Fire Department, and Haw River Fire Department can be contacted to respond to an emergency at the facility. 22. There was no indication of erosion or runoff. 23. The facility is receiving crushed asphalt for resale. Storage of the crushed asphalt is not in the active landfill area. 24. Access roads are of all-weather construction. 25. An attendant is on duty when the facility is in operation. 26. The facility is secured by a locked gate. 27. The facility has a proper sign. 28. The permit to construct expiration date was October 24, 2015. Prior to construction of the North and South Cells contact SWS – Permitting Branch/Perry Sugg for further discussion. 29. The PTO expiration date is April 24, 2019. 30. Permit renewal application shall be submitted to SWS by October 24, 2018.
