(c. 336-382-5912) STATUS OF PERMIT: Land Clearing and Inert Debris Landfill Notification recorded with the Guilford County Register of Deeds February 3, 2005 Current status of the Land Clearing and Inert Debris Landfill Notification is OPEN PURPOSE OF SITE VISIT: Comprehensive Inspection (to ensure that the notified land clearing and inert debris (LCID) landfill is in compliance with 15A North Carolina Administrative Code (NCAC) 13B .0563, .0564, and .0566) STATUS OF PAST NOTED VIOLATIONS: None OBSERVED VIOLATIONS: None The item(s) listed above were observed by Section staff and require action on behalf of the facility in order to come into or maintain compliance with the Statutes, Rules, and/or other regulatory requirements applicable to this facility. Be advised that pursuant to N.C.G.S. 130A-22, an administrative penalty of up to $15,000 per day may be assessed for each violation of the Solid Waste Laws, Regulations, Conditions of a Permit, or Order under Article 9 of Chapter 130A of the N.C. General Statutes. Further, the facility and/or all responsible parties may also be subject to enforcement actions including penalties, injunction from operation of a solid waste management facility or a solid waste collection service and any such further relief as may be necessary to achieve compliance with the North Carolina Solid Waste Management Act and Rules. FACILITY COMPLIANCE INSPECTION REPORT Division of Waste Management Solid Waste Section Page 2 of 3 ADDITIONAL COMMENTS On June 14, 2016, John Patrone met with Tom Lilly to conduct a comprehensive inspection of the Brame LCID Landfill on Warner Road in Kernersville, Guilford County. 1. The Brame LCID Landfill is a notified land clearing and inert debris (LCID) landfill. 2. The LCID landfill is estimated to be < 2 acres. 3. The LCID landfill is operated by Thomas Stanley Grading & Hauling, Inc. 4. The LCID landfill is primarily used by the grading company. 5. Mr. Lilly stated that land clearing debris (LCD) on site has been received within the last month and is positioned to be covered with soil in the next few days. 6. Per 15A NCAC 13B .0566(3), “Solid waste shall be restricted to the smallest area feasible and compacted as densely as practical into cells.” 7. Per 15A NCAC 13B .0566(4), “Adequate soil cover shall be applied monthly, or when the active area reaches one acre in size, whichever occurs first.” 8. Side slopes should be graded such that a 3:1 slope ratio is obtained or a ratio of which no indication of erosion or runoff is observed. 9. The LCID landfill has edge of waste markers (white plastic pipe) along the side slope. 10. Mr. Lilly stated that the area adjacent to the side slope contains only inert materials used as beneficial fill and is not considered part of the LCID landfill. 11. The beneficial fill area appeared to be covered with soil and graded accordingly. 12. Mr. Patrone suggested that the facility post signage designating the beneficial fill area from the LCID landfill. 13. Rebar shall be removed from concrete prior to being placed in the LCID landfill. 14. Mr. Lilly stated that the steel parking bollards dumped at the side slope will be removed. 15. A ready supply of soil shall be available on site for cover material. Mr. Lilly stated that the grading company commonly receives soil for cover material. 16. Open burning of solid waste is prohibited. 17. There was no indication of erosion or runoff. 18. The facility has an all-weather access road. 19. The facility is secured by a locked gate. 20. Ensure the facility sign contains contact name and phone number. 21. Mr. Brame will be mailed the LCID landfill notification application (to be recorded with the register of deeds and a copy sent to the SWS) in order to update operator information.
